DEBRIEFING TO UNSUCCESSFUL TENDERERS<br />

1. Within 10 calendar days following the receipt of the notification foreseen under Article<br />

45 of these Regulations, unsuccessful Tenderers may formally require in writing from<br />

the Contracts Officer who acted as joint secretary to the Tender Evaluation Board an<br />

oral debriefing explaining the reasons why their tender was not successful.<br />

2. Such oral debriefing shall usually take place at the Agency’s premises and be given by<br />

the concerned Contracts Officer (or in his absence by another Contracts Officer or his<br />

hierarchy) at a date to be agreed with the Tenderer. As a matter of guidance such<br />

debriefings should be given within 20 calendar days from the Agency receiving the<br />

formal written request.<br />

3. For procurements which have been the subject of a submission to the Industrial Policy<br />

Committee, the chairman of the Tender Evaluation Board shall participate in the<br />

debriefing.<br />

4. Explanations shall be limited to the findings of the Tender Evaluation Board on the<br />

tender in question, and shall not cover the quality or contents of other tenders.<br />

5. Minutes of any debriefing meetings shall be signed by the participants present and the<br />

original placed in the contract file.
