TIME LIMITS FOR TENDERING PERIOD<br />

1. Any prescribed time limit for the tendering period shall be adequate to allow for the<br />

preparation and submission of tenders before the closing date of the Invitation To Tender.<br />

2. In determining any such time limits, the Tender Evaluation Board shall, consistent with<br />

its own reasonable needs, take into account such factors as the complexity of the intended<br />

procurement and the extent of subcontracting anticipated.<br />

3. In the case of competitive tendering foreseen under Article 13 of these Regulations, the<br />

time limit for receipt of tenders shall in no circumstances be less than:<br />

a) 30 working days from the date on which the Invitation To Tender is published<br />

or dispatched for procurement actions superior or equal to 300 000 Euro.<br />

b) 20 working days for all other procurement actions provided such period would<br />

not create an unfair advantage to the benefit of one or more economic operators.<br />

4. In the case of non-competitive tendering foreseen under Article 14 of these<br />

Regulations, the time limit shall in no circumstances be less than:<br />

a) 30 working days from the date on which the Invitation To Tender is<br />

published for procurements above the thresholds set in Article 21 of these<br />

Regulations or in any other provisions replacing Article 21;<br />

b) 20 working days for all other procurement of non-standard supplies or<br />

services;<br />

c) 10 working days for the procurement of standard supplies or services which<br />

have no industrial policy implications. In cases of duly substantiated<br />

urgency this 10 working days time limit may be reduced.<br />

5. The Agency may, at its discretion and at any time during the time limit for receipt of<br />

tenders foreseen in the Invitation To Tender, extend such time limit.<br />

For the case foreseen under paragraph 3.b) above, an extension of a maximum period of<br />

up to 10 working days shall be granted automatically at the request of any Potential<br />

Bidder, provided such request reaches the Agency within the time limit prescribed in<br />

the Invitation To Tender for such requests.<br />

Such extension shall be communicated simultaneously to all Potential Bidders<br />

concerned on the same date and in a manner identical with that applicable in respect of<br />

the original Invitation To Tender‘s publication.
