2. The Director General shall maintain a potential bidders electronic registration system<br />

accessible through the public part of the Agency’s electronic medium dedicated to<br />

procurement where interested economic operators including tendering bodies designated<br />

by Member States, Associated States or Cooperating States are required to register<br />

directly and provide amongst other details, the information foreseen under paragraph 1.<br />

3. Should any registration be refused, the reasons for refusal shall be communicated for<br />

information both to the concerned economic operator and the Member State, Associate<br />

Member State or Cooperating State of the Agency to which that economic operator is<br />

considered to belong.<br />

4. Information provided by Potential Bidders may be used for the Agency’s internal<br />

purposes only and shall not be disclosed outside the Agency.<br />

5. Potential Bidders shall update their information every twelve (12) months.<br />

6. Where during this twelve month period the potential bidder finds itself in one of the<br />

situations foreseen under paragraphs 1.d) to 1.h) it shall so inform the Agency<br />

immediately in writing.<br />

7. A Member State, Associate Member State or Cooperating State shall upon its request<br />

be provided with a copy of the list of the Potential Bidders considered to belong to that<br />

State including tendering bodies.<br />

8. In the frame of arrangements and/or of procurements made with non-Member States,<br />

Associate States or Cooperating States, economic operators from those States may be<br />

required to satisfy the requirements laid down under the present Article and may be<br />

granted full or partial access to the non- public part of the Agency’s electronic medium<br />

dedicated to procurement.<br />

9. Where a Member State, Associate Member State or Cooperating State of the Agency<br />

requires access to any of the above information, such request shall be addressed in<br />

writing and, with the exception of the information foreseen under paragraph 7,<br />

disclosure by the Agency shall not be made prior to the receipt by the Agency of the<br />

written consent of the economic operator concerned.
