PART I: REVIEW BY THE AGENCY’S PROCUREMENT DEPARTMENT<br />

<strong>ARTICLE</strong> 1:<br />

PROCUREMENT DEPARTMENT’S COMPETENCE<br />

Pursuant to Article 51 of the Agency’s Procurement Regulations a claim referred to in<br />

Article 50 of Agency’s Procurement Regulations, shall, in the first instance be<br />

submitted to the Head of the Procurement Department or a person designated by him.<br />

<strong>ARTICLE</strong> 2:<br />

CONFLICT OF INTEREST<br />

Notwithstanding Article 1 of the present Implementing Instruction, if a claim referred<br />

to in Article 50 of the Agency’s Procurement Regulations is based on an act or decision<br />

taken directly by the Head of the Procurement Department, the claim shall be<br />

submitted directly to the Agency’s Industrial Ombudsman pursuant to Article 53 of the<br />

Agency’s Procurement Regulations.<br />

<strong>ARTICLE</strong> 3:<br />

TIME LIMITS AND SUPSENSION OF TIMES LIMITS<br />

FOR EXAMINATION OF CASES<br />

1. Pursuant to Article 51.4 of the Agency’s Procurement Regulations, the Head of the<br />

Procurement Department shall, within 10 calendar days after receiving the claim,<br />

issue a written decision to the claimant.<br />

2. Should the Head of the Procurement Department not issue his decision within the<br />

time limit specified in Section 1 above , the claimant pursuant to Article 51.5 of the<br />

Agency’s Procurement Regulations is entitled within 5 calendar days thereafter to<br />

submit his claim to the Agency’s Industrial Ombudsman.<br />

3. Where pursuant to Article 12.2 of the present Implementing Instruction or for any<br />

other reason, the Director General or the Head of the Procurement Department in<br />

order to reach a decision suspend the procurement process under review for a given<br />

period, the 10-day calendar period foreseen under Section 1 above shall be<br />

automatically suspended by the same period of time.<br />

When the suspension period ends the 10-day calendar period foreseen under Section<br />

1 above shall resume and the Head of the Procurement Department shall issue his<br />

written decision to the claimant within the time period remaining.<br />

<strong>ARTICLE</strong> 4:<br />

ESTABLISHMENT OF AN AGENCY’S PROCUREMENT<br />

REVIEW SUPPORT ENTITY (PRSE)<br />

1. The Head of the Procurement Department shall designate a staff member (s) of the<br />

Procurement Department (herein after referred to as Procurement Support Review<br />

Entity (PRSE)) who shall be competent for supporting the review process<br />

established under Part VI of the Agency’s Procurement Regulations.
