ANNEX I<br />

RULES OF PROCEDURE OF<br />

THE PROCUREMENT REVIEW BOARD<br />

Rule 1.<br />

SESSIONS<br />

1.1 The sessions of the Procurement Review Board (hereinafter referred to as the<br />

Board) shall be arranged by the Chairman or in his absence by the deputy<br />

Chairman, bearing in mind the need to take decisions within the time frame<br />

established under Article 55.3 of the Agency’s Procurement Regulations and the<br />

principle set under article 49.3 of the Agency’s Procurement Regulations.<br />

1.2 In order to avoid any vacancy of the Board, its members shall under the<br />

authority of the Chairman arrange among themselves for the permanent<br />

availability of at least three members including the Chairman or in his absence<br />

the Deputy Chairman at any given time.<br />

Rule 2.<br />

CONVENING<br />

The Board shall be convened by its Chairman or in his absence by the deputy<br />

Chairman, who will determine the agenda for each hearing and the place of<br />

meeting, usually its official seat.<br />

Rule 3.<br />

TIME LIMITS FOR EXAMINATION OF CASES<br />

3.1 The Board shall consider claims submitted to it not later than fifteen calendar<br />

days after the date on which they were lodged with the Chairman or in his<br />

absence with the deputy Chairman pursuant to Article 53.6 of the Agency’s<br />

Procurement Regulations.<br />

3.2 Where the Board is of the opinion that for the purpose of reaching a proper<br />

decision the time limit of fifteen calendar days needs to be extended, the<br />

Chairman or in his absence the deputy Chairman may extend this time limit by a<br />

further period not exceeding fifteen calendar days.<br />

3.3 When granting the extension referred to under paragraph 3.2 above the<br />

Chairman or in his absence the deputy Chairman shall take due account of the<br />

principle set under article 49.3 of the Agency’s Procurement Regulations.
