<strong>MEMORANDUM</strong> <strong>OF</strong> <strong>UNDERSTANDING</strong> (<strong>MOU</strong>)<br />

Between the Department of Animal Health of the Ministry of Agriculture and Rural<br />

Development of the Socialist Republic of Vietnam and the Canadian Food<br />

lnspection Agency under the authority of the Minister of Agriculture and Agri-Food<br />

of the Government of Canada.<br />

The Department of Animal Health of the Ministry of Agriculture and Rural Development of<br />

the government of the Socialist Republic of Vietnam and ,the Canadian Food lnspection<br />

Agency (CFI A), hereinafter referred to as "Parties";<br />

With the intention of establishing and developing cooperation between the two countries in<br />

the field of animal health and with a view to protecting each territory from contamination<br />

with animal diseases;<br />

And facilitating the exchange of animals, products of animal origin and animal reproductio~~<br />

materials between the two countries;<br />

Article I<br />

The Parties agree to co-operate in the field of animal health and on the implementation of<br />

any necessary methods to protect and eradicate animal diseases with the view of avoiding<br />

the entry of contamination with animal diseases from each country to the other, caused by<br />

the exchange of animals, products of animal origin and materials of animal reproduction.<br />

Article II<br />

The Parties will collaborate to prepare and to sign detailed agreements on sanitary,<br />

veterinary and genetical terms and conditions conducive to the safe export and import of<br />

animals and animal products from the territory of one Party to the other.


Article Ill<br />

The Parties will be responsible for the application and implementation of this <strong>MOU</strong>.<br />

Within the framework of this <strong>MOU</strong>, the Parties will:<br />

1 Exchange veterinary information,<br />

2. Exchange specific information on animal slaughtering, processing and animal<br />

diseases for export from its territory to the other.<br />

3. Establish opportunities for cooperation in the field of disease control, animal<br />

product inspection and veterinary research and diagnosis.<br />

4. Cooperate in the training and upgrading of professional skills for veterinary experts.<br />

Article IV<br />

The Parties are responsible for informing each other promptly of outbreaks within their own<br />

territory of any disease of which notification is considered compulsory by the Office<br />

International des Epizooties (OIE) and which is mentioned in List "A" of the International<br />

Animal Health Code of the aforementioned Organization. For List "6" diseases, the<br />

Parties will inform each other annually by means of the OIE annual report. In the case of<br />

Bovine Spongiform Encephalopathy (BSE), the Parties will inform each other immediately<br />

of a disease outbreak. As such, details about the place of outbreak, spread and other<br />

relevant epizootiological information, as well as measures carried out to eradicate and<br />

control the disease should be provided.<br />

Article V<br />

When deemed useful and according to this <strong>MOU</strong>, the Parties will cooperate on the<br />

exchange of delegations, workshops, research, study-visits, training as well as information<br />

on veterinary research.<br />

Article VI<br />

The Parties will be responsible for all of its own costs except as otherwise agreed upon by<br />

the authorized veterinary bodies.<br />

Article VI I<br />

Any disagreement regarding the explanation and implementation of this <strong>MOU</strong> will be<br />

solved through negotiation between the Parties.


Article Vlll<br />

The <strong>MOU</strong> may be modified when agreed in writing by the Parties.<br />

Article IX<br />

This <strong>MOU</strong> will not have any influence or have detrimental impacts on the rights and<br />

obligations of the Parties in any agreement signed by either Party with third Parties.<br />

Article X<br />

This <strong>MOU</strong> will enter into force on the date of signature, and shall remain in force until either<br />

Party informs the other in writing of its wish to terminate the <strong>MOU</strong>. Cancellation will<br />

become effective six (6) months after the written notification.<br />

Termination of this <strong>MOU</strong> shall not affect the execution of any obligation and contract<br />

formalized during the terms of the agreement.<br />

This <strong>MOU</strong> is made in (City, Country) OTTAWA. CANADA<br />

on (Date) Julv 3, 2002<br />

A Vietnamese version will be made prior to the time of the signing. The two versions are<br />

equally authentic.<br />
