I 8.04.010 COUNTy NUTSANCE COMpLAtNT<br />

on 02-06-09 at approximately 1530-hours I received a complaint for further investigation from Comm<strong>and</strong>er Bill Dalley of the Humboldt<br />

County Sheriffs Office. This complaint was received on 02-06-09 by the Humboldt County Sheriffs Office from the Humboldt county Clerks<br />

Office. Winnemucca, Nevada in Humboldt Countv.<br />

This complaint consists of a written "nuisance" reporVcomplaint from the Paradise Ranchos Fire Department through it,s Assistant Fire<br />

Chief' That Assistant Fire Chief is a Mr. Stanley Thompson. The initial complaint on this event was filed by Mr. Thompson through the<br />

Humboldt County Clerks Office on 02-05-09.<br />

Based on the Humboldt County Nuisance Complaint Form, Mr. Thompson filed a "nuisance complaint" on the property <strong>and</strong> owners of a<br />

home located at 4800 Paiute Trails Road. winnemucca, Nevada in Humboldt county.<br />

The complaint filed by Mr' Thompson states that this property is covered with trash, plastic bags <strong>and</strong> that these items of ref<strong>us</strong>e blow on1<br />

the Fire Ho<strong>us</strong>e property at 4910 Paradise Ranchos Drive. Mr. Thompson states that this type of event has been a problem for a year or<br />

more' Please see the Nuisance Complaint Form filed by Mr. Thompson attached with this report.<br />

Based on Humboldt County Code 8.04.030 this complaint was sent to the Humboldt County Sheriffs office. As per Humboldt Countv<br />

Code 8.04.030 section-B, this "nuisance,' complaint was investigated.<br />

On 02-06-09 at approximately 1630-hours I did go to the address of 4800 Paiute Trails Road for the investigative purposes of this<br />

complaint. No investigative action was taken with regard to making contact with or interviewing anyone living at the address of 4g00 paiute<br />

Trails Road. I did not attempt to speak with anyone at this home based on the fact that this type of complaint appears to carry a lengthy<br />

process of hearings <strong>and</strong> investigations by Humboldt County Officials. This complaint appears to be civil in nature at this point based on<br />

Humboldt County Code 8.04.120' This Humboldt County Code section outlines that a person is guilty of a Misdemeanor if a person "fails,, or<br />

"neglects" within the required time after notice to comply with a nuisance remedy correction. At this point, this event is in the first stages of<br />

it's investigative process <strong>and</strong> it appears that due process m<strong>us</strong>t be given before a criminal elemg4t attaches to this esmplaint-. -<br />

Based on this determination I did however take other investigative action. Specifically, t toox ta-separate digital pictures of the address<br />

of 4B00 Paiute Trails <strong>and</strong> the surrounding area. I took these pictures from the public <strong>and</strong> county maintained roadway of paradise Ranchos<br />

Drive' These pictures are limited based on my limited access around this property. The pictures are primarily taken from a southern facing<br />

direction.<br />

My observations of this address <strong>and</strong> the general area showed that there "may" in-fact be a valid nuisance complaint at the address of<br />

4800 Paiute Trails Road. My observations are supported by the digital pictures which are attached with this report as well several other<br />

factors.<br />

In addition to trash, plastic, <strong>and</strong> other items of debris <strong>and</strong> garbage I also saw that there were 2-separate vehicles on the property that<br />

appeared "un<strong>us</strong>ed". As per Humboldt County Code 8.04.010 "un<strong>us</strong>ed items such as equipment <strong>and</strong> Motor Vehicles,' are defined under this<br />

nuisance code' In addition, it is my interpretation of county code 8.04.010 section F that un<strong>us</strong>ed or ab<strong>and</strong>oned Motor Vehicles are to be<br />

"fully screened from view" from the outside of a property. These vehicles were not. These vehicles did not appear to be operational.<br />

The trash, plastic <strong>and</strong> debris that I saw was strewn between the Paradise Ranchos Fire Ho<strong>us</strong>e <strong>and</strong> the address of 4800 paiute Trails<br />

Drive' There is a fenced <strong>and</strong> undeveloped lot that separate these two locations. The trash, plastic <strong>and</strong> debris was not strewn entirely acros:<br />

this entire lot- This ref<strong>us</strong>e was primarily concentrated in areas on this lot where there was Sagebr<strong>us</strong>h which the items of trash were caught<br />

<strong>and</strong> tangled into. The dimensions of this vacant, fenced <strong>and</strong> undeveloped l<strong>and</strong> are not known for the purposes of this narrative. In addition,<br />

the distance between the fire ho<strong>us</strong>e <strong>and</strong> the 4800 Paiute Trails Drive residence was not measured. I found it a moot point to do so.<br />

The trash that was spread across this fenced <strong>and</strong> undeveloped lot was plainly viewabfe from the main roadway of paradise Ranchos<br />

Drive. Aside from the "visual" perspective I did not find or see anything else from this trash that was offensive to the senses. tt was my<br />

opinion that the manner in which this trash was strewn across this fenced/undeveloped lot was much like the trash, garbage <strong>and</strong> debris that<br />

is strewn across the undevelopedesert area east of the Humboldt county L<strong>and</strong>fitt. The difference that I saw was the fact that the address<br />

of 4800 Paiute Trails Drive sits in near proximity to the Paradise Ranchos Fire Ho<strong>us</strong>e <strong>and</strong> other homes. Whereas the Humboldt County<br />

L<strong>and</strong>fill sits in an almost isolated location. In addition, I noted that the trash <strong>and</strong> debris from the 4800 paiute Trails Drive address was<br />

concentrated in one general area which is the fenced <strong>and</strong> undeveloped lot between the fire ho<strong>us</strong>e <strong>and</strong> this home.<br />

It appeared to me that the trash' garbage <strong>and</strong> debris which was in this area could have come from garbage not being regularly removed<br />

from the 4800 Paiute Trails Drive address <strong>and</strong> that with the combination of weather such as wind, trash had been blown into <strong>and</strong> across this<br />
