NOTICE PER HUMBOLDT COLINTY CODE 8.04.050
NOTICE IS HEREBY GIVEN that a Complaint of Existence ofNuisance
has been filed with the Humboldt County Clerk on property located at 4800
Paiute Trail Road, Winnemucca, Nevada and owned by Shawn & Stephanie
Bruffett. The legal description of said property is as follows: Lot 1, Paradise
Valley Ranchos Subdivision #1 Section 23, T39N R3BE APN #006- 164-27
4.750 acres.
Per HCC 8.040.050, this notice is being served Lrpon the person owning
the premises according to the cuffent tax roll, the person in possession, charge
or control of,the yard, lot or premises upon which the potential nuisance exists
and the person or persons filing said complaint. Said notice is also being posted
at the site of the potential nuisance.
Saicl Complaint stated the following facts as cause for the complaint:
"Property is covered with trash, plastic bag & etc blows onto fire house
property at 4910 Paradise Ranchos this has been a on goingproblemfor ayear
or more" per HCC 8.04.020
Upon receipt of the complaint inspections were completed by the
Humboldt County Sheriffls Offlce, the Humboldt County Road Department and
the Humboldt County Building & Safety Department. Said reports are hereby

I 8.04.010 COUNTy NUTSANCE COMpLAtNT
on 02-06-09 at approximately 1530-hours I received a complaint for further investigation from Commander Bill Dalley of the Humboldt
County Sheriffs Office. This complaint was received on 02-06-09 by the Humboldt County Sheriffs Office from the Humboldt county Clerks
Office. Winnemucca, Nevada in Humboldt Countv.
This complaint consists of a written "nuisance" reporVcomplaint from the Paradise Ranchos Fire Department through it,s Assistant Fire
Chief' That Assistant Fire Chief is a Mr. Stanley Thompson. The initial complaint on this event was filed by Mr. Thompson through the
Humboldt County Clerks Office on 02-05-09.
Based on the Humboldt County Nuisance Complaint Form, Mr. Thompson filed a "nuisance complaint" on the property and owners of a
home located at 4800 Paiute Trails Road. winnemucca, Nevada in Humboldt county.
The complaint filed by Mr' Thompson states that this property is covered with trash, plastic bags and that these items of refuse blow on1
the Fire House property at 4910 Paradise Ranchos Drive. Mr. Thompson states that this type of event has been a problem for a year or
more' Please see the Nuisance Complaint Form filed by Mr. Thompson attached with this report.
Based on Humboldt County Code 8.04.030 this complaint was sent to the Humboldt County Sheriffs office. As per Humboldt Countv
Code 8.04.030 section-B, this "nuisance,' complaint was investigated.
On 02-06-09 at approximately 1630-hours I did go to the address of 4800 Paiute Trails Road for the investigative purposes of this
complaint. No investigative action was taken with regard to making contact with or interviewing anyone living at the address of 4g00 paiute
Trails Road. I did not attempt to speak with anyone at this home based on the fact that this type of complaint appears to carry a lengthy
process of hearings and investigations by Humboldt County Officials. This complaint appears to be civil in nature at this point based on
Humboldt County Code 8.04.120' This Humboldt County Code section outlines that a person is guilty of a Misdemeanor if a person "fails,, or
"neglects" within the required time after notice to comply with a nuisance remedy correction. At this point, this event is in the first stages of
it's investigative process and it appears that due process must be given before a criminal elemg4t attaches to this esmplaint-. -
Based on this determination I did however take other investigative action. Specifically, t toox ta-separate digital pictures of the address
of 4B00 Paiute Trails and the surrounding area. I took these pictures from the public and county maintained roadway of paradise Ranchos
Drive' These pictures are limited based on my limited access around this property. The pictures are primarily taken from a southern facing
direction.
My observations of this address and the general area showed that there "may" in-fact be a valid nuisance complaint at the address of
4800 Paiute Trails Road. My observations are supported by the digital pictures which are attached with this report as well several other
factors.
In addition to trash, plastic, and other items of debris and garbage I also saw that there were 2-separate vehicles on the property that
appeared "unused". As per Humboldt County Code 8.04.010 "unused items such as equipment and Motor Vehicles,' are defined under this
nuisance code' In addition, it is my interpretation of county code 8.04.010 section F that unused or abandoned Motor Vehicles are to be
"fully screened from view" from the outside of a property. These vehicles were not. These vehicles did not appear to be operational.
The trash, plastic and debris that I saw was strewn between the Paradise Ranchos Fire House and the address of 4800 paiute Trails
Drive' There is a fenced and undeveloped lot that separate these two locations. The trash, plastic and debris was not strewn entirely acros:
this entire lot- This refuse was primarily concentrated in areas on this lot where there was Sagebrush which the items of trash were caught
and tangled into. The dimensions of this vacant, fenced and undeveloped land are not known for the purposes of this narrative. In addition,
the distance between the fire house and the 4800 Paiute Trails Drive residence was not measured. I found it a moot point to do so.
The trash that was spread across this fenced and undeveloped lot was plainly viewabfe from the main roadway of paradise Ranchos
Drive. Aside from the "visual" perspective I did not find or see anything else from this trash that was offensive to the senses. tt was my
opinion that the manner in which this trash was strewn across this fenced/undeveloped lot was much like the trash, garbage and debris that
is strewn across the undevelopedesert area east of the Humboldt county Landfitt. The difference that I saw was the fact that the address
of 4800 Paiute Trails Drive sits in near proximity to the Paradise Ranchos Fire House and other homes. Whereas the Humboldt County
Landfill sits in an almost isolated location. In addition, I noted that the trash and debris from the 4800 paiute Trails Drive address was
concentrated in one general area which is the fenced and undeveloped lot between the fire house and this home.
It appeared to me that the trash' garbage and debris which was in this area could have come from garbage not being regularly removed
from the 4800 Paiute Trails Drive address and that with the combination of weather such as wind, trash had been blown into and across this

fenced and undeveloped lot which in turn caused trash, plastic and debris to be blown toward the Fire Department. This was not a case of
blatant dumping or storage of trash and garbage.
The unused cars were a different issue. lt is not known if these vehicles run however they did not appear to do so. These two s€parstr
vehicles appeared to be undrivable and were simply being held on the property.
Based on this investigation I submit that this event and the information contained should be reviewed for possible further action to inclu
but not be limited to starting the actions outlined in county code 8.04.040 and 8.04.050.
I would note however, that with the exception of the two vehicles noted in this narrative, it appears to me that the correction of this matt,
would be a simple process. That process could include but is not limited to an extensive walking and gathering of the trash, plastic and
debris from the area by the owners of the property at 4800 Paiute Trails Drive. And, admonishing the property owners to have a better way
of securing and/or removing their garbage to prevent items from being blown onto or around the area. At this point this report should be se
to the proper Humboldt County official(s) based on the outlined process of Humboldt County Code 8.04.010, 8.04.030, 8.04.040 and any
other related process within this section of the Humboldt Countv Code Index,
