7. POWERS OF DELEGATION<br />

Delegations of<br />

Committees<br />

7.1<br />

Unless expressly provided otherwise in the LGA 2002 or any other Act, a<br />

local authority may delegate to a committee any of its responsibilities,<br />

duties, or powers for the purposes of efficiency and effectiveness in the<br />

conduct of the local authority's business, except:<br />

(a)<br />

(b)<br />

(c)<br />

(d)<br />

(e)<br />

(f)<br />

the power to make a rate; or<br />

the power to make a bylaw; or<br />

the power to borrow money, or purchase or dispose of assets,<br />

other than in accordance with the long-term council community<br />

plan; or<br />

the power to adopt a long-term council community plan, annual<br />

plan, or annual report; or<br />

the power to appoint a Chief Executive; or<br />

the power to adopt policies required to be adopted and consulted<br />

on under this Act in association with the long-term council<br />

community plan or developed for the purpose of the local<br />

governance statement.<br />

7.2<br />

Every committee to which any powers or duties are delegated may,<br />

without confirmation by the local authority, exercise or perform them in like<br />

manner and with the same effect as the local authority could itself have<br />

exercised or performed them.<br />

Subcommittees<br />

7.3<br />

Any committee may delegate any of the responsibilities, duties or powers<br />

of the committee to any subcommittee appointed by the committee subject<br />

to any conditions, limitations or prohibitions imposed by the local authority<br />

or by the committee that makes the delegation.<br />

8. MEMBERS OF COMMITTEES AND SUBCOMMITTEES<br />

8.1<br />

A local authority may appoint or discharge any member of a committee or<br />

a subcommittee. Unless directed otherwise by the local authority, a<br />

committee may appoint or discharge any member of a subcommittee<br />

appointed by the committee.<br />

8.2<br />

A local authority or committee may appoint to any committee or<br />

subcommittee any person who is not an elected member of the local<br />

authority if, in the opinion of the local authority, that person has<br />

knowledge, skills or attributes that will assist the work of the committee
