Litigation Concerning Abortion<br />

Legislation. In the 2009<br />

session, the Legislature passed<br />

a bill making a number of<br />

changes to <strong>Arizona</strong>’s laws concerning<br />

abortions. The legislation<br />

was challenged in lawsuits<br />

filed in state and federal court.<br />

The State court granted a preliminary<br />

injunction preventing<br />

enforcement of major pieces of<br />

that legislation while the lawsuit<br />

is pending. That decision is<br />

presently on appeal. In con-<br />

The Solicitor <strong>General</strong>’s Office<br />

coordinates production of the<br />

<strong>Attorney</strong> <strong>General</strong>’s opinions. In<br />

fiscal year <strong>2010</strong>, the <strong>Attorney</strong><br />

opinion requests and requests<br />

Meeting Law Enforcement Team<br />

(“OMLET”), SGO assisted with<br />

the processing of more than 60<br />

open meeting law complaints.<br />

These complaints involved<br />

public entities from throughout<br />

the State. If a violation is<br />

found, the remedies typically<br />

involve training, monitoring, and<br />

discussions of the allegations<br />

and the results of the investigation<br />

at a public meeting.<br />

Serious violations may result<br />

in civil penalties and removal<br />

from office. OMLET lawyers also<br />

participate in training programs<br />

that educate the public and<br />

public officials on open meeting<br />

law requirements.<br />
