Sales Management Comments<br />

We excitedly head into the 2011 version of “Red & Black” after realizing a wonderful event in 2010. The “reality” of the<br />

event is maybe what makes it an annual favorite of ours. The high quality offering comes from a great cross-section of<br />

breeders who represent the “everyday man” premise of the sale. Now, in saying that, it’s not like we haven’t syndicated<br />

bulls through this sale or seen many show champions highlight it over the years, but appreciate the sincerity and freshness<br />

that seems to have embraced the event.<br />

Maybe most accurately, the combination of the dual sales (Ultimate Red & Black and Fleckvieh Equation) together, gives<br />

the rest of Canada an excellent reflection of the essence of Simmental in Alberta and British Columbia. This event really<br />

epitomizes the heart of the Simmental industry in the far West and the breeder core that exists. The natural honesty and<br />

innocence of the sale combined with real world cattle and humble attitudes is largely the attraction factor of the event.<br />

Jay had selected this heifer for the Trust sale, but we felt it was better to keep our sale<br />

animals together. She is the first heifer to be offered from Jazzy, a black cow that we<br />

purchased from GSB Simmentals. The only reason that this heifer is being offered for<br />

sale is that we have all her sisters in herd. Being a Texas calf makes her really hard to<br />

part with as well, the shape and thickness of his offspring have been impressive and<br />

have been well received in our bull sales. This should be one to produce top calves<br />

year after year. We used Bravado last year and we found that his calves usually came<br />

This heifer, or “Fancy” as she has been called around our farm has definitely stood out right from the<br />

start. The battle between Dad and myself as to whether she would be going to this sale this fall was<br />

constant. As you can all see, Dad still has the final say around our place, and she is up for bids. Fancy<br />

Xstatic is a heifer that shouldn’t be leaving the farm. She exhibits wonderful qualities such as a neck<br />

extension, wide hip, extra volume, great hair and a remarkable temperament. We were so impressed<br />

with the development of this heifer and her full brother, we flushed the cow the same way. Due to<br />

embryo siblings coming, we offer this very special female to you. We lost Revolution this spring during<br />

breeding season and this could be one of only a few females ever on offer out of the 2010 National<br />

Champion Bull. Due to a likely false second heat/heat detection error, Xstatic is bred to either Hummer<br />

or Intuition. Beechinor Bros will pay for the DNA test on the calf. Either way the calf has all the<br />

makings to be incredible.<br />

Terms & Conditions<br />

TERMS - The terms of the sale are cash or cheque payable at par at sale location unless satisfactory credit arrangements have been made previous to the sale. The right of property shall not pass<br />

until after settlement is made. <strong>Transcon</strong> <strong>Livestock</strong> Corp. reserves the right to require a certified cheque as settlement before releasing any sale cattle. Should any purchaser fail to settle for his<br />

purchase <strong>Transcon</strong> <strong>Livestock</strong> Corp. reserves full power to resell the animal to the best advantage either publicly or privately, without further notice. Any loss arising from such resale together with<br />

keep and all other expenses shall be payable by the defaulter. All settlements must be made with the clerks of the sale before any cattle will be released.<br />

BID - Every animal consigned to the sale must be sold by auction. No private sales will be allowed except as otherwise provided for in the terms and conditions. No by-bidding will be permitted.<br />

Each animal will be sold to the highest bidder.<br />

DISPUTES - In cases of disputes, bidding will be reopened between the parties involved. If no further bid is made the buyer will be the person from whom the auctioneer accepted the last bid.<br />

The auctioneer’s decision in such matters will be final.<br />

PURCHASER’S RISK - Each animal becomes the risk of the purchaser as soon as sold. Animals will be cared for at the purchaser’s risk for a reasonable length of time.<br />

INFORMATION SUPPLIED - The information contained in this catalog is believed to be true and accurate. However, the information has been supplied by the seller and neither <strong>Transcon</strong> <strong>Livestock</strong><br />

Corp. or Jamesway Enterprises Ltd. assume any responsibility if the information supplied is not accurate.<br />

CATTLE PICTURES - The images in this catalog are believed to be accurate representations of the individual animals. <strong>Transcon</strong> <strong>Livestock</strong> Corp. and Jamesway Enterprises Ltd. assume no<br />

ANNOUNCEMENTS from the auction block will take precedence over the printed matter in the catalog. Buyers are therefore cautioned to pay attention to any such announcements.<br />

CERTIFICATE OF REGISTRY - A registration/recordation certificate issued by the applicable breed association and duly transferred will be furnished to the buyer of each animal after settlement<br />

has been made. It is the responsibility of the buyer to determine the acceptance of this certificate in any other association.<br />

SHIPPING - Assistance will be given in making shipment after the sale but no risk is assumed by the Sales Management or Seller. Expenses incurred are the responsibility of the purchaser.<br />

Purchasers are requested to furnish shipping instructions when making settlement.<br />

BREEDERS GUARANTEE - As per applicable Canadian Breed Association Breeding Guarantee guidelines. Copies are available at the sale settlement desk to be picked up by the buyer at any<br />

time. In no event shall the seller be responsible for reimbursing more than the purchase price.<br />

EXCEPTION TO GUARANTEE - In cases where the animal is subjected to any hormonal or surgical reproduction techniques after the sale, the guarantee shall be null and void.<br />

HEALTH - It is the buyer’s responsibility to determine health requirements for importing any animal into his province or state. <strong>Transcon</strong> <strong>Livestock</strong> Corp. assumes no responsibility for the health<br />

status of any animal in the sale.<br />

ACCIDENTS - Although every precaution will be taken to protect the safety and comfort of buyers, neither the Sales Management, auctioneer, consignors. or Association assumes any responsibility<br />

in this matter and disclaims any liability legal or otherwise in the event of accident or loss of property.<br />

RIGHTS AND OBLIGATIONS - The above terms and conditions of the sale shall constitute a contract between the buyer and the seller and be equally binding to both. Resale of animals following<br />

purchase in this sale shall constitute a separate transaction and the rights and obligations of the two parties connected thereto are not covered by the terms and conditions of this sale.<br />

TRANSCON LIVESTOCK CORP. IS AGENT ONLY - It is to be clearly understood that <strong>Transcon</strong> <strong>Livestock</strong> Corp. is only acting as a medium between buyer and seller and is not in any way responsible<br />

for any failure on the part of either party to live up to his obligations, neither does <strong>Transcon</strong> <strong>Livestock</strong> Corp. assume any financial obligations to collect or enforce collection of any monies between<br />

parties, and any legal action that may, in exceptional cases, be taken, must be between buyer and seller.<br />

The Auctioneer shall have the right to refuse bids from anyone who has a previous record of default in payment or who has not made proper credit clearance prior to the sale with the owner or<br />
