New MM&P Jobs With APL<br />

news briefs<br />

MM&P is pleased to announce that there will be new jobs for MM&P members at American President Lines (APL). Over the course <strong>of</strong><br />

the next six months, this long-time MM&P employer will be replacing its four U.S.-flag C-10 Class vessels with four newer S-12 Class<br />

vessels as part <strong>of</strong> its Maritime Security Program<br />

(MSP) fleet.<br />

Two <strong>of</strong> the four S-12 Class vessels are currently<br />

under contract with the American Maritime<br />

Officers. <strong>The</strong>se vessels, the MV Cyprine and the<br />

MV Pearl, will join the MV Agate and the<br />

MV Coral under MM&P contract. <strong>The</strong> transfer <strong>of</strong><br />

MSP vessels and the resulting terms <strong>of</strong> employment<br />

are in accordance with the existing collective<br />

bargaining agreement between MM&P and<br />

APL.<br />

Although the C-10 Class ships—MV President<br />

Adams, MV President Jackson, MV President<br />

Polk and MV President Truman—will be leaving<br />

the MSP program, they are slated to remain<br />

in U.S.-flag operation under the terms <strong>of</strong> the<br />

MM&P-APL collective bargaining agreement for<br />

non-MSP vessels. <strong>The</strong>se developments will result<br />

in a net gain <strong>of</strong> two ships under contract and will<br />

safeguard the jobs <strong>of</strong> all MM&P members currently<br />

employed aboard the vessels.<br />

APL President Truman. Although the C-10 Class ships will be leaving the MSP program, they<br />

are slated to remain under U.S.-flag operation under the terms <strong>of</strong> the MM&P-APL collective<br />

bargaining agreement for non-MSP vessels.<br />

Puerto Rico Has Jones Act to Thank<br />

For 20,000 Maritime Jobs, MM&P Tells GAO<br />

Representatives <strong>of</strong> MM&P met in San Juan in April with <strong>of</strong>ficials<br />

<strong>of</strong> the U.S. Government Accountability Office (GAO), a research<br />

arm <strong>of</strong> the federal government. Participants in the meeting<br />

included MM&P Pilot Group member Capt. Roberto Candelario,<br />

MM&P Puerto Rico Representative Eduardo Iglesias and MM&P<br />

<strong>International</strong> Counsel Gab Terrasa.<br />

<strong>The</strong> meeting took place in the context <strong>of</strong> a study requested by<br />

a politician, Puerto Rico Resident Commissioner Pedro Pierluisi,<br />

who has asked the GAO to examine “the impact <strong>of</strong> the Jones Act<br />

on the economy <strong>of</strong> Puerto Rico.” <strong>The</strong> Jones Act is the body <strong>of</strong> law<br />

that requires that ships in America’s domestic trades be built in<br />

U.S. shipyards, crewed by U.S.-citizen mariners and operated by<br />

U.S. companies. Pierluisi says his goal is “to determine once and<br />

for all the impact the Jones Act has on our economy… [because]<br />

a broad array <strong>of</strong> economists in Puerto Rico have expressed concern<br />

that the Jones Act hinders the island’s economic growth…”<br />

First <strong>of</strong>f, the MM&P representatives told GAO that the<br />

Jones Act guarantees thousands <strong>of</strong> well-paying maritime jobs<br />

to residents <strong>of</strong> Puerto Rico. Candelario, who is president <strong>of</strong><br />

the San Juan Pilots Association, also underlined the fact that<br />

only American maritime workers are subject to Department <strong>of</strong><br />

Homeland Security background and security checks. He pointed<br />

out that exempting Puerto Rico from the Jones Act would give<br />

access to the island’s waterways and ports to foreign companies<br />

and foreign maritime workers not subject to U.S. background<br />

and security checks.<br />

Transportation costs <strong>of</strong> Jones Act ships do not have a significant<br />

influence on the final market price <strong>of</strong> goods in Puerto Rico,<br />

the three MM&P representatives told GAO. In the U.S. Virgin<br />

Islands, for example, market prices <strong>of</strong> U.S. manufactured goods<br />

are comparable to or higher than those in Puerto Rico. <strong>The</strong><br />

Virgin Islands, which are part <strong>of</strong> the United States and in close<br />

proximity to Puerto Rico, are outside the Jones Act and completely<br />

open to foreign-flag ships.<br />

Candelario, Iglesias and Terrasa told the GAO <strong>of</strong>ficials that<br />

higher market prices in Puerto Rico and the Virgin Islands<br />

compared to mainland U.S. prices are due to a lack <strong>of</strong> economy<br />

<strong>of</strong> scale in the distribution system and control <strong>of</strong> the distribution<br />

system by a limited number <strong>of</strong> suppliers.<br />

“We don’t believe the final market prices <strong>of</strong> goods going into<br />

or out <strong>of</strong> Puerto Rico would be significantly changed if U.S.<br />

ships were replaced by foreign-flagged ships,” Candelario said.<br />

“<strong>The</strong> major impact would be to shift wages, pr<strong>of</strong>its, taxes and<br />

the economic contributions <strong>of</strong> U.S. jobs into the hands <strong>of</strong> foreign<br />

interests—to the detriment <strong>of</strong> the U.S. economy and U.S. jobs.”<br />

Maritime Unions Call on<br />

Congress to Take Action<br />

on Insufficient<br />

Shipboard Manning<br />

Burgeoning paperwork loads and regulatory duties are increasing<br />

the risk <strong>of</strong> maritime accidents worldwide. At a time when carriers<br />

have reduced crewing levels, ships’ <strong>of</strong>ficers are required to<br />

manage the workload generated by a rapidly expanding number <strong>of</strong><br />

government regulations. Representatives <strong>of</strong> <strong>of</strong>ficers aboard U.S.-<br />

flag ships are calling on Congress to urgently review the situation<br />

and respond to the growing risks it entails for people, the environment<br />

and pr<strong>of</strong>essional mariners—who are increasingly being held<br />

criminally liable for accidents.<br />

“<strong>The</strong> criminalization <strong>of</strong> simple pr<strong>of</strong>essional error—<strong>of</strong>ten the<br />

result <strong>of</strong> fatigue or excessive workload—is without justification<br />

when there is no oversight regarding the sufficiency <strong>of</strong> personnel<br />

available to carry out shipboard responsibilities,” says the MM&P<br />

<strong>International</strong> Secretary-Treasurer. “While the number <strong>of</strong> crewmembers<br />

has been reduced, the number <strong>of</strong> international, federal<br />

and state regulations that must be complied with and documented<br />

has grown exponentially.”<br />

<strong>The</strong> MM&P <strong>of</strong>ficial made the remarks in Congressional testimony<br />

April 26 before members <strong>of</strong> the House Subcommittee on<br />

Coast Guard and Maritime Transportation. He spoke on behalf <strong>of</strong><br />

members <strong>of</strong> MM&P, the Marine Engineers’ Beneficial Association<br />

(MEBA) and the American Maritime Officers (AMO). Together,<br />

the three unions represent almost all the captains and licensed<br />

engineering and deck <strong>of</strong>ficers aboard U.S.-flag merchant vessels in<br />

the international trade.<br />

“<strong>The</strong> choice is <strong>of</strong>ten between attending to the traditional duties<br />

that affect the safe operation <strong>of</strong> the ship or documenting compliance<br />

with a multitude <strong>of</strong> regulations,” the MM&P <strong>International</strong><br />

Secretary-Treasurer told members <strong>of</strong> Congress.<br />

“Regrettably, paperwork and perfunctory reporting requirements<br />

are <strong>of</strong>ten prioritized at the expense <strong>of</strong> real safety.”<br />

U.S. maritime <strong>of</strong>ficers are calling on Congress to direct the<br />

Coast Guard to conduct an assessment <strong>of</strong> fatigue and crewing<br />

levels based on the recommendations <strong>of</strong> independent pr<strong>of</strong>essionals<br />

experienced in workplace fatigue. To read the testimony in its<br />

Note: MM&P members are reminded that it is necessary to<br />

comply with all applicable international and federal rest requirements.<br />

If there are instances in which the level <strong>of</strong> work exceeds<br />

the permissible hours <strong>of</strong> duty, safety must be the priority and<br />

non-conformity reports must be submitted to the employer in<br />

accordance with the requirements <strong>of</strong> the <strong>International</strong> Ship<br />

Management Code.<br />

This letter was distributed to all MM&P LDOs<br />

and posted in all MM&P Union Halls.<br />

MM&P Brothers and Sisters:<br />

As you know, effective Jan. 1, new international STCW<br />

regulations pertaining to rest hours have been enacted.<br />

Unfortunately, at this time the U.S. Coast Guard has<br />

not provided any guidance or regulation to address the<br />

changes. It appears that each company will attempt to<br />

comply with the international regulations on an individual<br />

basis.<br />

MM&P has long held the position that the crewing<br />

scales used by vessels in today’s environment are inadequate:<br />

the present crewing scales required by the USCG<br />

were adequate for a vessel trading in the 1950s or 1960s.<br />

Under today’s regulatory scheme and operational tempo,<br />

it is clear that the minimum crewing requirements are<br />

deficient.<br />

MM&P has sought a process to address the fatigue that<br />

results from inadequate crewing levels. We have investigated<br />

the USCG’s “Crew Endurance Management” program<br />

and, with different employers, have experimented<br />

with alternate watch schedules. It is clear to anyone<br />

familiar with the current practices aboard liner vessels that<br />

the problem is not with the management <strong>of</strong> available work<br />

hours. <strong>The</strong> problem is that there are not enough <strong>of</strong>ficers<br />

aboard ship to do the required work.<br />

Economic competition has prevented progress in the<br />

area <strong>of</strong> adequate crewing scales: if one <strong>of</strong> our contracted<br />

companies wanted to hire sufficient <strong>of</strong>ficers to accomplish<br />

the assigned tasks, it would find itself at a significant economic<br />

disadvantage.<br />

In recent years, MM&P has worked to focus attention<br />

on crewing scales. <strong>The</strong> union participates as an active<br />

delegate in many international rule-making forums and<br />

working groups. We have asked regulators to address<br />

fatigue and crewing levels in a practical manner. One<br />

<strong>of</strong> the results <strong>of</strong> our efforts and the work <strong>of</strong> other concerned<br />

organizations was the adoption last year by the<br />

<strong>International</strong> Maritime <strong>Organization</strong> (IMO) <strong>of</strong> revised<br />

“Principles <strong>of</strong> Minimum Safe Manning.” Unfortunately,<br />

the principles are voluntary guidelines, and the Coast<br />

Guard has not changed its regulations or processes to<br />

comply with them.<br />

<strong>The</strong> new work hour regulations represent one method<br />

<strong>of</strong> addressing fatigue issues. Establishing appropriate<br />

crewing levels is a top-down approach; a mandatory rest<br />

hour requirement is a bottom-up approach. If there are<br />

not enough available man hours to complete the job, in<br />

accordance with the ISM process, companies should be<br />

required to address the work load placed on ship’s <strong>of</strong>ficers.<br />

MM&P’s position on the issue is as follows.<br />

MM&P strongly advises all members to follow U.S.<br />

and international regulations completely. If a regulation<br />

cannot be complied with, the employer should be notified<br />

immediately so that the employer can take corrective<br />

action. Violations <strong>of</strong> STCW work hour limits should also<br />

be reported to your MM&P Area Vice President. <strong>The</strong> ISM/<br />

SMS process is the appropriate process for notifying your<br />

employer. This process protects you and, if properly followed,<br />

places the ultimate responsibility for safe crewing<br />

levels on the employer.<br />

MM&P is aware that there will be significant pressure<br />

to use the available work hours to the maximum extent<br />

possible. MM&P cautions its <strong>of</strong>ficers standing Navigational<br />

Watches against any activity that detracts from the constant<br />

vigilance required in proper watch keeping.<br />

<strong>The</strong> MM&P master collective bargaining agreement is<br />

clear regarding what can and what cannot be done while<br />

standing a Navigational Watch. <strong>The</strong> language has not<br />

changed or been otherwise modified since at least 1975. It is<br />

the standard that all MM&P <strong>of</strong>ficers should adhere to.<br />

Section XXXIX Part 4<br />

4. Navigation Watches<br />

a. A navigation watch shall be defined as a watch stood by<br />

a Licensed Deck Officer on the bridge when the vessel<br />

is underway. Except in the event <strong>of</strong> an emergency, or for<br />

reasons <strong>of</strong> personal privilege, the Licensed Deck Officer<br />

in charge <strong>of</strong> the navigating watch shall not be relieved<br />

by the Master, nor sent away from the immediate vicinity<br />

<strong>of</strong> the navigating bridge, wheelhouse or chartroom<br />

unless relieved by a Licensed Deck Officer other than<br />

the Master.<br />

b. No restrictions shall be placed on the use <strong>of</strong> any aid to<br />

navigation located on the bridge or on the use <strong>of</strong> charts<br />

or publications. Violations <strong>of</strong> this Subsection shall be<br />

brought to the attention <strong>of</strong> the Joint Safety Committee<br />

for action.<br />

c. When a vessel is manned by less than the number <strong>of</strong><br />

Licensed Deck Officers required by this Agreement,<br />

the Licensed Deck Officers, excluding the Master, shall<br />

divide the watches.<br />

d. A Licensed Deck Officer in charge <strong>of</strong> a navigation<br />

watch shall not perform any paperwork other than that<br />

connected with the immediate navigation <strong>of</strong> the vessel.<br />

This specifically means that they shall not:<br />

(i) Correct charts, light lists, or any other aid to<br />

navigation document not immediately in use.<br />

(This does not mean that a watch <strong>of</strong>ficer will make<br />

corrections from Notices to Mariners or any other<br />

source on a sea watch. It does mean that notations<br />

may be made on a chart or in a publication relating<br />

to things like incorrect characteristics <strong>of</strong> lights,<br />

wrecks sighted, etc.)<br />

(ii) Work on Commander’s reports, voyage abstracts,<br />

port reports, abstracts <strong>of</strong> passages, whether separate<br />

or incorporated on other than the daily working<br />

page <strong>of</strong> the Log Book, weather maps, special<br />

position or weather reports (excluding NOAA<br />

or U.S. Weather Bureau messages or USMER or<br />

AMVER messages) required by the Company or<br />

a Charterer. All such work when authorized to<br />

be performed at sea shall be performed on the<br />

Officer’s watch below.<br />

e. When a vessel is at anchor in open roadsteads or<br />

congested waters an alert anchor watch shall be maintained<br />

on the bridge when working barges, for the<br />

safety <strong>of</strong> the vessel, its crew and cargo.<br />

MM&P understands the stress that each <strong>of</strong>ficer will face<br />

under the new regulations. We believe the pressure will<br />

continue to escalate unless all vessel operators are required<br />

to crew their vessels adequately. MM&P members: it is<br />

necessary to comply with the international and U.S. laws<br />

and regulations regarding the mandatory hours <strong>of</strong> rest.<br />

Comply with these first, and then attempt to accomplish<br />

the myriad <strong>of</strong> non-critical company requirements second.<br />

This is the best way to protect your license/Merchant<br />

Mariner Credential and your union brothers and sisters<br />

from regulatory action.<br />

Strong Opposition Meets U.S.-U.K. Proposal<br />

To “Discourage Ransom Payments to Pirates”<br />

A proposal by British Prime Minister David Cameron to “discourage the payment <strong>of</strong> ransoms to pirates” is evoking sharp criticism<br />

from shipping organizations, labor unions, seafarers’ rights groups and the marine insurance industry.<br />

<strong>The</strong> Round Table <strong>of</strong> international shipping associations and the Save Our Seafarers campaign (SOS) have written to Cameron<br />

and other U.K. government <strong>of</strong>ficials to say they are “highly disturbed” by statements made by U.K. and U.S. <strong>of</strong>ficials at the<br />

London Somalia Conference earlier this year. During the conference, Cameron and U.S. Secretary <strong>of</strong> State Hilary Clinton discussed<br />

creating an international task force to study policies to discourage ransom payments.<br />

<strong>The</strong> proposal “is a continuation <strong>of</strong> the U.S. State Department’s ill-conceived notion that piracy can be stopped by denying the<br />

payment <strong>of</strong> ransom, a position which ignores the human cost <strong>of</strong> sacrificing the lives <strong>of</strong> innocent seafarers,” says the MM&P Pilots<br />

Group Vice President. “It is particularly troubling that governments have not mounted a robust and effective campaign against<br />

acts <strong>of</strong> piracy, the shore bases that permit pirates to operate and the tracking <strong>of</strong> ransom money to the financiers <strong>of</strong> piracy,” he<br />

adds. “<strong>The</strong>re is no doubt that denying the payment <strong>of</strong> ransom will result in the death <strong>of</strong> seafarers, which is totally unacceptable to<br />

the maritime community.”<br />

“This could be a disaster for the shipping industry,” says Alistair Evitt, chairman <strong>of</strong> Save Our Seafarers, who was quoted in an<br />

interview published in the April 26 issue <strong>of</strong> Fairplay. “<strong>The</strong>re has to be a system to get the seafarer released.”<br />

MM&P, the Marine Engineers’ Beneficial Association and other U.S. maritime unions have spoken out strongly against the<br />

idea <strong>of</strong> blocking ransom payments since it was first floated in a 2010 Obama Administration Executive Order.<br />

“<strong>The</strong>re is a vast difference between blocking the payment <strong>of</strong> funds to criminals where there are no consequences… and blocking<br />

ransom payments intended to protect the lives <strong>of</strong> innocent hostages,” the unions say. <strong>The</strong>y are calling on the United States<br />

instead to place armed military detachments exercising governmental authority aboard U.S.-flag ships transiting waters subject to<br />

pirate attacks.<br />

Re-Elect U.S. Representative<br />

Colleen Hanabusa!<br />

America’s maritime unions are expressing strong support<br />

for Colleen Hanabusa, a member <strong>of</strong> the House <strong>of</strong><br />

Representatives who is campaigning for re-election to<br />

the seat she won in 2010.<br />

Hanabusa, a labor lawyer, says she chose a career in<br />

public service to fight for low-income communities like<br />

the ones on Oahu’s Leeward Coast, where she grew up.<br />

<strong>The</strong> granddaughter <strong>of</strong> sugar cane workers, Hanabusa<br />

was elected President <strong>of</strong> the Hawaii State Senate in 2006,<br />

becoming the first woman to lead either house <strong>of</strong> the<br />

state legislature.<br />

A strong supporter <strong>of</strong> the Jones Act and maritime<br />

labor, Hanabusa is credited with fighting back an attempt<br />

to shut down the Pacific Tsunami Warning Center in<br />

Oahu. She also played a central role in the fight to secure<br />

more than $500 million for vital military construction<br />

projects in Hawaii.<br />

Maersk Wyoming!<br />

Last year the Maersk Wyoming participated in a company-sponsored fund-raising<br />

campaign for United Seamen’s Service (USS). <strong>The</strong> ship’s crew collected over<br />

$1,000, which was matched by Maersk Line Limited. <strong>The</strong> vessel and its crew were<br />

Sen. John McCain Thwarted<br />

In Yet Another Attempt to Repeal the Jones Act<br />

Arizona Republican Sen. John McCain failed March 26 in an attempt to attach legislation repealing the Jones Act to an energy bill.<br />

<strong>The</strong> Jones Act protects the jobs <strong>of</strong> American mariners by requiring that ships that are American-built, -flagged and -crewed carry<br />

goods between U.S. ports. McCain has made repealing the Jones Act a central point <strong>of</strong> his career. His most recent attempt to eliminate<br />

the Jones Act was blocked by Senate Majority Leader Harry Reid (D-Nev.), who restricted the number <strong>of</strong> amendments that could be<br />

attached to the energy bill, S 2204. McCain had filed four amendments that would have repealed or waived the Jones Act as it applies to<br />

oil and petroleum product tank vessels, liquefied natural gas carriers and small passenger vessels.<br />

MM&P Members in San Francisco<br />

Pilot Supersize Containership<br />

Capt. John Carlier and Capt. Ed Melvin <strong>of</strong> the San<br />

Francisco Bar Pilots were at the conn <strong>of</strong> the giant<br />

containership MSC Fabiola on March 22 when it<br />

made a port call in Oakland, becoming the largest<br />

vessel ever to enter San Francisco Bay.<br />

At 1,201 feet MSC Fabiola is longer than an aircraft<br />

carrier and has a capacity <strong>of</strong> approximately 12,500<br />

20-foot-long containers. At full load, the ship moves<br />

166,000 tons. On its arrival in San Francisco, it drew<br />

36 feet <strong>of</strong> water while only half full.<br />

A total <strong>of</strong> 19 pilots were involved in the five-daylong<br />

simulator study to prepare for the ship’s arrival<br />

and departure. Capt. Carlier brought MSC Fabiola in<br />

from the sea, carefully timing its entrance with the<br />

currents in the bay. Capt. Melvin turned it around<br />

in the estuary, a particularly complicated maneuver<br />

Bar Pilots were involved in planning for and executing the ship’s arrival and departure<br />

from Oakland in March.<br />

because the turning basin is about 1,500 feet wide, leaving only 150 feet <strong>of</strong> clearance at each end <strong>of</strong> the ship.<br />

<strong>The</strong> pilots carried special computer navigation devices so they would have their own information as to course, speed and heading.<br />

Equally critical was another data set elaborated by the independent pilot computers: the rates <strong>of</strong> turn at the bow and the stern. It’s very<br />

important that both ends move at as close to the same speed as possible so that the ship remains in the center <strong>of</strong> the turning circle without<br />

gaining headway, sternway or sliding away from the center.<br />

Captain Neal Nyberg, who has retired after 32<br />

years <strong>of</strong> service on U.S. Army Corps <strong>of</strong> Engineers’<br />

hopper dredges, was honored by his shipmates<br />

and the members <strong>of</strong> the <strong>Masters</strong>, <strong>Mates</strong> & Pilots<br />

for his years <strong>of</strong> service to the nation, the Army<br />

Corps and the union. Essayons Third Mate Steve<br />

Perry and Nyberg’s shipmates aboard the dredge<br />

presented him with a plaque from the union that<br />

reads: “In Appreciation to Captain Neal Nyberg,<br />

U.S. Army Corps <strong>of</strong> Engineers, Outstanding<br />

<strong>of</strong>ficer, gentleman and tireless advocate for<br />

the members <strong>of</strong> the <strong>Masters</strong>, <strong>Mates</strong> & Pilots<br />

Federal Membership Group.” <strong>The</strong> plaque was<br />

signed by the MM&P <strong>International</strong> President on<br />

behalf <strong>of</strong> the union’s General Executive Board.<br />

Nyberg graduated from the California Maritime<br />

Academy in 1979 and worked for a short period<br />

on ocean towboats, then shipped out <strong>of</strong> the<br />

MM&P hall on tankers. He has worked on five<br />

army dredges out <strong>of</strong> the Portland District, the<br />

past 22 as captain <strong>of</strong> the Essayons.<br />

that you provided on the piracy dangers <strong>of</strong>f the coast <strong>of</strong> Somalia and how<br />

ships such as yours defend yourselves is helpful knowledge to our CJTF-<br />

HOA Staff,” wrote Navy Captain Joseph J. Horvath in a follow-up memo to<br />

MM&P Stands Shoulder to Shoulder<br />

With Workers at Verizon!<br />

Members <strong>of</strong> the Communications Workers <strong>of</strong> America (CWA) who rallied<br />

recently in Long Beach, Calif., for a fair contract got some support from the<br />

maritime unions: they were joined by MM&P member Robin Llewellyn and<br />

members <strong>of</strong> the Marine Fireman’s Union (MFOW) and the Sailors’ Union <strong>of</strong><br />

the Pacific (SUP). Members <strong>of</strong> CWA and the <strong>International</strong> Brotherhood <strong>of</strong><br />

Electrical Workers (IBEW) have been battling for a fair contract for almost<br />

a year. Verizon’s demands include: freezing the value <strong>of</strong> pensions for active<br />

workers and eliminating them entirely for new workers; slashing disability<br />

benefits for workers injured on the job; eliminating all job security language<br />

and continuing outsourcing <strong>of</strong> work to low-wage, low-benefit, non-union<br />

contractors domestically and overseas; imposing health care payments up to<br />

$6,700 on retired workers and $6,800 on active workers; eliminating paid sick<br />

days entirely for new workers; limiting paid sick days to no more than five for<br />

all other workers.<br />

Protecting Our Industry<br />

Through Advocacy in Washington and on the Home Front<br />

MM&P members, union <strong>of</strong>ficials and representatives<br />

<strong>of</strong> MM&P-contracted companies<br />

were part <strong>of</strong> a 155-person group that visited<br />

the <strong>of</strong>fices <strong>of</strong> 170 members <strong>of</strong> Congress on<br />

<strong>May</strong> 9 to call attention to the important role<br />

played by the American maritime industry in<br />

our country’s security, economy and national<br />

defense. <strong>The</strong> meetings were part <strong>of</strong> the third annual<br />

Maritime Industry Congressional Sail-In.<br />

In discussions with members <strong>of</strong> Congress and their<br />

staffs, Sail-In participants underlined the importance <strong>of</strong><br />

the Jones Act, the Maritime Security Program (MSP) and<br />

cargo preference laws. A major focus <strong>of</strong> the discussions: the<br />

hundreds <strong>of</strong> thousands <strong>of</strong> Americans who work directly or<br />

indirectly for the U.S.-flag fleet and the contributions they<br />

make to our nation’s economy.<br />

“No industry has been more vital to the success <strong>of</strong> our<br />

country than America’s maritime industry,” according to a<br />

report released in conjunction with the Sail-In by the Navy<br />

League <strong>of</strong> the United States. “Our U.S.-flag fleet provides<br />

jobs for hundreds <strong>of</strong> thousands <strong>of</strong> ‘Maritime Americans’<br />

in every corner <strong>of</strong> our nation: from longshoremen in ports<br />

along our four seacoasts, to towboat operators navigating<br />

the Mississippi, to shipbuilders in East Coast dry docks, to<br />

the men and women who crew American-flag vessels <strong>of</strong> all<br />

types.”<br />

<strong>The</strong> report, “America’s Maritime Industry: <strong>The</strong><br />

Foundation <strong>of</strong> American Seapower,” is an unprecedented<br />

look at our industry as a whole. It describes the relationships<br />

among industry participants and explains why weakening<br />

any one <strong>of</strong> the key maritime programs that support it would<br />

compromise the entire U.S.-flag fleet.<br />

Supporting our forces overseas<br />

<strong>The</strong> Sail-In aims to educate legislators and their staffs on a<br />

number <strong>of</strong> topics. Few people outside the maritime industry<br />

are aware, for example, that our government has dramatically<br />

increased its reliance on privately owned U.S.-flag<br />

commercial vessels and civil service mariners for the sealift<br />

capability needed to deploy and sustain U.S. forces overseas.<br />

Since 2008, as noted in the Navy League report, the share<br />

<strong>of</strong> dry cargo moved by U.S.-flag commercial vessels and<br />

their civilian American crews has increased to 95<br />

percent.<br />

<strong>The</strong> American maritime industry moves<br />

cargo and troops around the world in far greater<br />

volume and with far greater efficiency than<br />

any other transportation mode. “Whether by<br />

U.S.-flag vessels in commercial service or by<br />

U.S.-government or chartered American ships, since<br />

2004 virtually 100 percent <strong>of</strong> all equipment and supplies<br />

for our forces in Iraq and Afghanistan has been transported<br />

by U.S.-flag ships manned by U.S. citizen mariners,” the Navy<br />

League says.<br />

<strong>The</strong>se statistics demonstrate a fundamental truth <strong>of</strong> which<br />

we in the maritime industry are well aware: that the Maritime<br />

Americans who own, operate and crew the U.S.-flag fleet guarantee<br />

that our forces overseas have what they need to do their<br />

jobs on our behalf. A major goal <strong>of</strong> the Sail-In is to get the word<br />

out: to legislators in Washington and to the public at large.<br />

Feeding the world’s hungry<br />

Few people outside the maritime industry are aware that many<br />

<strong>of</strong> the same companies and individuals who transport supplies<br />

to our forces overseas are also engaged in international relief<br />

efforts. America is, in fact, the world’s largest provider <strong>of</strong> food<br />

aid. Through the Food for Peace Program, since 1954 more than<br />

three billion people in 150 countries have benefitted from the<br />

generosity <strong>of</strong> the American people.<br />

Just as Maritime Americans deliver the goods to American<br />

troops, they deliver the food that feeds the world’s hungry and<br />

advances America’s longstanding humanitarian objectives. In<br />

the words <strong>of</strong> the Navy League, Maritime Americans are the ones<br />

who “ensure U.S. food aid reaches people in need, and in the<br />

process generate international goodwill, building connections<br />

between the United States and developing nations.” Participants<br />

in the Sail-In are working to spread the word about the importance<br />

<strong>of</strong> food aid cargos that move by sea.<br />

An essential source <strong>of</strong> jobs<br />

<strong>The</strong> Jones Act, the body <strong>of</strong> law that ensures that America’s<br />

domestic trades are served by American vessels and crews, is <strong>of</strong><br />

inestimable importance to our military, economic and homeland<br />

security, as well as to our national and local tax base. Along with<br />

<strong>May</strong> - <strong>June</strong> <strong>2012</strong> - 8 - <strong>The</strong> Master, Mate & Pilot


MSP and the cargo preference laws, the Jones Act is a fundamental<br />

pillar <strong>of</strong> the U.S.-flag fleet.<br />

<strong>The</strong> operation <strong>of</strong> Jones Act vessels supports approximately<br />

500,000 American jobs. Equally important, the<br />

operation <strong>of</strong> U.S.-flag vessels in the domestic trades helps<br />

ensure that our nation maintains the cadre <strong>of</strong> trained, loyal<br />

civil service mariners essential to the Department <strong>of</strong> Defense<br />

in time <strong>of</strong> war or other international emergency.<br />

A key objective <strong>of</strong> the Sail-In is to educate members <strong>of</strong><br />

Congress and their staffs about the number and variety <strong>of</strong><br />

American jobs that depend, either directly or indirectly,<br />

on the U.S.-flag fleet, and about how important our cadre<br />

<strong>of</strong> highly trained pr<strong>of</strong>essional mariners is to maintaining<br />

America’s defense capabilities in the short- and long-term.<br />

<strong>The</strong> need for grassroots action<br />

<strong>The</strong> Sail-In is unique in that it brings individuals who<br />

work in our industry to the nation’s capital to visit with<br />

their members <strong>of</strong> Congress as constituents, as Maritime<br />

Americans and as a united maritime industry. But as<br />

important as the Sail-In is, it is not enough. We must work<br />

year-round to educate and inform. For this reason, MM&P,<br />

the Marine Engineers’ Beneficial Association (MEBA)<br />

and others have joined forces to implement a broad-based<br />

campaign. <strong>The</strong> grassroots education program is based on<br />

Maritime Action Committees comprised to the fullest extent<br />

possible <strong>of</strong> individuals who live in each member’s district or<br />

state.<br />

<strong>The</strong> premise is simple: the more members <strong>of</strong> Congress<br />

know about our industry and about how important it is to<br />

their constituents and to the United States as a whole, the<br />

more they will understand that the programs and policies that<br />

support the U.S.-flag merchant marine should be fully funded<br />

and implemented. This information, in turn, puts each member<br />

<strong>of</strong> Congress in a better position to respond to attacks against our<br />

industry and to advocate on its behalf.<br />

<strong>The</strong> grassroots campaign is a sustained effort. It will take time,<br />

energy and money, and it will require the involvement <strong>of</strong> all who<br />

share our concern about the future <strong>of</strong> our industry. Please contact<br />

Christy Pekara<br />

Christy joined MM&P in 2004, after graduating from Texas A&M University. She lives in<br />

John Walkup<br />

A graduate <strong>of</strong> New York Maritime College, John<br />

joined MM&P in 2004. He and his wife, Teresa,<br />

live in San Diego and are expecting their first<br />

child in August. John ships out <strong>of</strong> MM&P’s Los<br />

Angeles/Long Beach Hall. “I enjoy the outdoors,<br />

especially hiking, mountain biking and surfing,”<br />

Did you know <strong>The</strong> “Deck Club” in the MITAGS Residence Hall hosts a happy<br />

hour on Sundays from 5:00 to 7:00 p.m. All drinks are $1 <strong>of</strong>f, and there are hot<br />

hors d’oeuvres. Since most new students arrive on Sunday, happy hour at the<br />

Deck Club <strong>of</strong>fers a chance to socialize before beginning class. By the way, the<br />

lounge also has ESPN!<br />

Visitors who smoke cigarettes, cigars or pipes can now choose<br />

seating in one <strong>of</strong> two special areas near the covered walkway,<br />

outside the Academic Building and the Residence Hall. <strong>The</strong><br />

booths were added in response to requests from non-smoking<br />

guests who asked that smoking be restricted in other areas <strong>of</strong> the<br />

Stop-Loss Insurance<br />

<strong>The</strong> Segal Company, the Health & Benefit Plan’s<br />

consultant, has recommended to the Trustees<br />

that the PMR/CNW Group purchase stop-loss<br />

insurance to minimize the impact <strong>of</strong> future<br />

catastrophic and unforeseen medical claims on<br />

the Group’s rates. <strong>The</strong> insurance would help<br />

minimize potential future rate increases by<br />

stabilizing the Group’s claims experience. <strong>The</strong> Chairman and the<br />

Secretary, in consultation with the United Inland Group Vice<br />

President, have agreed to this recommendation.<br />

<strong>The</strong> Segal Company is obtaining bids from insurance carriers<br />

through a Request for Proposal (RFP) to determine what options<br />

for this type <strong>of</strong> insurance coverage are available. It is estimated<br />

that the Plan will be able to have this insurance in place for an<br />

effective date <strong>of</strong> July 1, <strong>2012</strong>, and that the policy period will be for<br />

one year. Segal has estimated that the cost <strong>of</strong> coverage will be $30<br />

to $40 per participant per month and that all individuals (members<br />

and dependents) will be covered. <strong>The</strong> estimated premium<br />

amount was included in the April 1 rate increase.<br />

When the coverage is in place, the Plan will be required to<br />

report monthly to the insurance carrier all individuals on whose<br />

behalf the Plan has paid claims in the amount <strong>of</strong> at least $50,000<br />

during the policy period. When claims for an individual meet<br />

the $150,000 or $200,000 deductible for the stop-loss coverage<br />

(depending on what insurance is purchased), the insurance<br />

company will reimburse the Plan any amount above that dollar<br />

amount.<br />

<strong>The</strong> Plan will handle all the premium payments and filings<br />

required by the insurance company. <strong>The</strong> participant or dependent<br />

should carefully review all charges on every Explanation <strong>of</strong><br />

Benefits (EOB) statement to make sure that all the medical care<br />

billed has actually been received. If you notice any discrepancy,<br />

please contact your provider and question the charges. If the<br />

charges are not correct, please notify the Plan Office.<br />

Medicare Part D<br />

For pensioners and their dependents who are covered under<br />

Medicare and are secondary under the MM&P Health & Benefit<br />

Plan, the Plan’s Prescription Drug Program has been and continues<br />

to be comparable to the prescription coverage <strong>of</strong>fered<br />

by the Medicare Part D Program. <strong>The</strong> Plan in September 2011<br />

sent participants the required annual notice explaining that<br />

the Plan’s prescription coverage is “creditable” for <strong>2012</strong>. This is<br />

why we advise pensioners and dependents not to enroll in the<br />

Medicare Part D program. <strong>The</strong> only exception is for retirees and<br />

dependents belonging to the Columbia Northwest Group; their<br />

prescription drug coverage is “non-creditable.” Participants and<br />

dependents in the Columbia Northwest Retiree Group should<br />

enroll in the Medicare Part D Prescription Drug Program.<br />

Because the MM&P Health & Benefit Prescription Drug<br />

Program is “creditable,” the Plan has applied for and received a<br />

subsidy for a percentage <strong>of</strong> the prescription drug costs incurred<br />

by Medicare-eligible Offshore retirees and dependents. To<br />

receive the subsidy, every year the Plan must file an application<br />

with the Center for Medicare and Medicaid Services (CMS).<br />

<strong>The</strong> subsidy equals approximately 28 percent <strong>of</strong> the cost <strong>of</strong> the<br />

prescription drug benefit <strong>of</strong> this Group.<br />

For the <strong>2012</strong> calendar year, the Plan’s application has been<br />

approved. For 2011, the Plan requested and received approximately<br />

$1,074,800 in subsidies, which have helped defray the<br />

costs <strong>of</strong> providing this benefit to the Plan’s Offshore retirees and<br />

dependents.<br />

Pension Plan<br />

Annual Funding Notice<br />

As required by federal law, the Plan has mailed the Annual<br />

Funding Notice for Plan Year Jan. 1, 2011 through Dec. 31, 2011<br />

to: all participants and beneficiaries, participating employers<br />

and the <strong>International</strong> <strong>Organization</strong> <strong>of</strong> <strong>Masters</strong>, <strong>Mates</strong> & Pilots.<br />

<strong>The</strong> notice was also e-mailed to the Pension Benefit Guaranty<br />

Corporation (PBGC). <strong>The</strong> notice was mailed at the end <strong>of</strong> April<br />

<strong>2012</strong>.<br />

<strong>The</strong> Plan is required to report in the notice on how well<br />

funded it is on the basis <strong>of</strong> a measure called “funded percentage.”<br />

<strong>The</strong> percentage is calculated by dividing the Plan’s assets by its<br />

liabilities on the Valuation Date for the Plan Year. <strong>The</strong> notice<br />

is required to include the Plan’s funded percentage for the Plan<br />

Year and for each <strong>of</strong> the two preceding Plan Years. <strong>The</strong> notice<br />

also includes the year-end Fair Market Value <strong>of</strong> Assets as <strong>of</strong> the<br />

last day <strong>of</strong> the Plan Year and each <strong>of</strong> the two preceding Plan<br />

Years.<br />

<strong>The</strong> notice includes the total number <strong>of</strong> participants in the<br />

Plan and a breakdown <strong>of</strong> how many were active, retired or separated<br />

from service and receiving benefits, as well as how many<br />

participants were retired or separated from service and entitled<br />

to future benefits. <strong>The</strong> last chart on the notice shows how the<br />

Plan’s assets were allocated in accordance with the Plan’s investment<br />

policy. <strong>The</strong> chart shows these allocations as percentages <strong>of</strong><br />

total assets.<br />

Vacation Plan<br />

Electronic Funds Transfer/Direct Deposit<br />

<strong>The</strong> Plan would like to remind Vacation Plan participants that<br />

they have the option <strong>of</strong> receiving their vacation benefits and<br />

Port Relief Officer (PRO) payments as a paper check or as an<br />

electronic funds transfer (EFT)/direct deposit into their designated<br />

bank account. An authorization to perform the transaction<br />

electronically must be on file. For any change to your bank and/<br />

or account information, the Plan is required to process a verification<br />

(called a pre-note process) through the banking system.<br />

Once this process has been completed, each time you apply<br />

for a vacation or PRO benefit you have the option <strong>of</strong> receiving a<br />

check or having your benefit processed by EFT/direct deposit.<br />

<strong>The</strong> Plan Office processes the EFTs on a daily basis which allows<br />

members to have their benefits credited into their account in a<br />

being outdoors, and loved the ocean and fishing. His<br />

wife, Hae Ryon, daughter, Jennifer, granddaughter,<br />

Natalia, sisters, Joan and Teddy, and brother, Tom,<br />

times in his last year and hiked many miles on the<br />

served in the Navy during<br />

Vietnam War, he worked<br />

Foreign Wars, American Legion, Masonic Lodge and<br />

Historical Society. His brother, Thomas, three nieces,<br />

two nephews, four grandnieces and one grandnephew<br />
