16-5.5 Regional <strong>Planning</strong> Commission Recommendation.<br />
Upon receipt of the motion, certification of resolution, or the application, along with the copy of the<br />
proposed text and map changes, the Regional <strong>Planning</strong> Commission shall at its regular meeting recommend<br />
the approval or denial of the proposed amendment or the approval of some modification of the amendment<br />
pursuant to the standards in Section 16-4. This recommendation shall be submitted to the Rural Zoning<br />
Commission.<br />
16-5.6 Rural Zoning Commission Recommendation.<br />
The Rural Zoning Commission shall, within thirty (30) days after their public hearing recommend the<br />
approval or denial of the proposed amendment, or the approval of some modification of the amendment<br />
pursuant to the standards in Section 16-4. The Rural Zoning Commission shall then submit its<br />
recommendation together with the proposed text and map changes and the recommendation of the Regional<br />
<strong>Planning</strong> Commission to the Board of <strong>County</strong> Commissioners.<br />
16-5.7 Board of <strong>County</strong> Commissioners Action.<br />
a. Schedule of Hearing. Upon receipt of the recommendation from the Rural Zoning Commission, the<br />
Board of <strong>County</strong> Commissioners shall hold a public hearing within thirty (30) days in accordance with<br />
the procedures outlined in Section 16-7.<br />
b. Decision. Within twenty (20) days after the public hearing, the Board shall either adopt or deny the<br />
recommendation of the Rural Zoning Commission or adopt some modification of the recommendation<br />
by the Rural Zoning Commission. In making its decision, the Board shall consider the factors<br />
contained in Section 16-4. In the event the Board denies or modifies the recommendation of the Rural<br />
Zoning Commission, the unanimous vote of the Board shall be required.<br />
c. Effective Date. An amendment adopted by the Board of <strong>County</strong> Commissioners shall become<br />
effective in thirty (30) days after the date of adoption unless within that time period a petition for<br />
zoning referendum is presented in accordance with the requirements of the <strong>Ohio</strong> Revised Code. (see<br />
Appendix 4)<br />
16-6 REFERENDUM.<br />
16-6.1 Petition Time Limit.<br />
Within thirty (30) days after the date of adoption of an amendment by the Board, a petition may be<br />
presented to the Board of <strong>County</strong> Commissioners requesting that the Board submit the amendment to the<br />
electors of that area, for approval or rejection, at a special election to be held on the day of the next primary<br />
or general election.<br />
16-6.2 Petition Signatures.<br />
The petition must be signed by the number of qualified voters residing in the unincorporated area of the<br />
township or part thereof included in the zoning plan equal to not less than eight percent (8%) of the total<br />
vote cast for all candidates for governor in such area at the last preceding general election at which the<br />
governor was elected.<br />
16-6.3 Petition Content.<br />
Each part of the petition for zoning referendum shall contain the number and full and correct title, if any, of<br />
the zoning amendment resolution, motion or application, as the case may be, furnishing the name by which<br />
the amendment proposal is known and a brief summary of its contents. Each petition and Statement of the<br />
Circulator shall, in addition, conform to the rules specified in Section 3501.38 of the <strong>Ohio</strong> Revised Code as<br />
shown in Appendix 4.
