Article 1.<br />

The Nati<strong>on</strong>al <strong>Energy</strong> <strong>Authority</strong> is a specific state <strong>in</strong>stituti<strong>on</strong> under <strong>the</strong> auspices of <strong>the</strong> M<strong>in</strong>ister of<br />

Industry, <strong>Energy</strong> and Tourism.<br />

Article 2.<br />

The ma<strong>in</strong> roles of <strong>the</strong> Nati<strong>on</strong>al <strong>Energy</strong> <strong>Authority</strong> are:<br />

1. To advise <strong>the</strong> Government <strong>on</strong> energy issues and o<strong>the</strong>r resource issues that <strong>the</strong> <strong>Authority</strong> is<br />

resp<strong>on</strong>sible for accord<strong>in</strong>g to legislati<strong>on</strong> and to give <strong>the</strong> authorities c<strong>on</strong>sultati<strong>on</strong>s and reviews<br />

of <strong>the</strong>se matters.<br />

2. To carry out research <strong>on</strong> energy <strong>in</strong> <strong>Iceland</strong>, <strong>the</strong> energy resources, <strong>on</strong>-land and off-shore, and<br />

<strong>on</strong> o<strong>the</strong>r m<strong>in</strong>eral and water resources <strong>in</strong> order to facilitate <strong>the</strong>ir quantificati<strong>on</strong> and to give<br />

c<strong>on</strong>sult<strong>in</strong>g services to <strong>the</strong> authorities <strong>on</strong> sensible and ec<strong>on</strong>omical development of <strong>the</strong><br />

resources.<br />

3. To ga<strong>the</strong>r data <strong>on</strong> energy resources and o<strong>the</strong>r m<strong>in</strong>eral and water resources, <strong>the</strong>ir utilisati<strong>on</strong> and<br />

<strong>the</strong> energy utilisati<strong>on</strong> of <strong>Iceland</strong>, to preserve <strong>the</strong> data and to dissem<strong>in</strong>ate <strong>the</strong> <strong>in</strong>formati<strong>on</strong> to <strong>the</strong><br />

authorities and <strong>the</strong> public.<br />

4. To prepare l<strong>on</strong>g-term plans <strong>on</strong> <strong>the</strong> energy utilisati<strong>on</strong> of <strong>Iceland</strong> and <strong>the</strong> development of energy<br />

resources and o<strong>the</strong>r m<strong>in</strong>eral and water resources, <strong>on</strong>-land and off-shore.<br />

5. To facilitate <strong>the</strong> cooperati<strong>on</strong> of parties that c<strong>on</strong>duct energy research and <strong>the</strong> coord<strong>in</strong>ati<strong>on</strong> <strong>the</strong><br />

research projects.<br />

6. To m<strong>on</strong>itor, <strong>on</strong> behalf of <strong>the</strong> M<strong>in</strong>ister, <strong>the</strong> implementati<strong>on</strong> of licenses granted for research and<br />

utilisati<strong>on</strong> of m<strong>in</strong>eral and water resources and <strong>the</strong> operati<strong>on</strong> of power plants and o<strong>the</strong>r large<br />

energy facilities.<br />

7. To adm<strong>in</strong>ister <strong>the</strong> Nati<strong>on</strong>al <strong>Energy</strong> Fund.<br />

The Nati<strong>on</strong>al <strong>Energy</strong> <strong>Authority</strong> shall also undertake o<strong>the</strong>r adm<strong>in</strong>istrative tasks which <strong>the</strong> <strong>Authority</strong> is<br />

assigned to by legislati<strong>on</strong>, adm<strong>in</strong>istrative <strong>in</strong>structi<strong>on</strong>s or <strong>the</strong> M<strong>in</strong>ister’s decisi<strong>on</strong>s.<br />

The Nati<strong>on</strong>al <strong>Energy</strong> <strong>Authority</strong> is authorised to c<strong>on</strong>clude agreements with companies or <strong>in</strong>stituti<strong>on</strong>s <strong>on</strong><br />

implementati<strong>on</strong> of def<strong>in</strong>ed tasks, cf. items 2 and 3 of paragraph 1. Any agreements exceed<strong>in</strong>g two years<br />

durati<strong>on</strong> shall be submitted to <strong>the</strong> M<strong>in</strong>ister for approval.<br />

The Nati<strong>on</strong>al <strong>Energy</strong> <strong>Authority</strong> may cooperate with service companies or <strong>in</strong>stituti<strong>on</strong>s regard<strong>in</strong>g<br />

services, such as operati<strong>on</strong> of hous<strong>in</strong>g, teleph<strong>on</strong>e service, IT service, etc.<br />

In order to uphold its obligati<strong>on</strong>s accord<strong>in</strong>g to item 3 of paragraph 3, <strong>the</strong> Nati<strong>on</strong>al <strong>Energy</strong> <strong>Authority</strong><br />

may demand documentati<strong>on</strong>s c<strong>on</strong>cern<strong>in</strong>g <strong>the</strong> utilisati<strong>on</strong> of m<strong>in</strong>eral and water resources, energy producti<strong>on</strong><br />

and energy usage, <strong>in</strong>cl. documentati<strong>on</strong>s c<strong>on</strong>cern<strong>in</strong>g import, storage and market<strong>in</strong>g of fossil fuels. Those<br />

engaged <strong>in</strong> <strong>the</strong> preced<strong>in</strong>g professi<strong>on</strong>al enterprises are obligated to provide <strong>the</strong> <strong>Authority</strong> with all <strong>the</strong><br />

necessary documents with<strong>in</strong> a time limit specified by <strong>the</strong> <strong>Authority</strong>. Fur<strong>the</strong>r c<strong>on</strong>diti<strong>on</strong>s <strong>on</strong> <strong>the</strong> type of<br />

documentati<strong>on</strong>s, quality and <strong>the</strong> deadl<strong>in</strong>e for submissi<strong>on</strong> shall be stated <strong>in</strong> a Regulati<strong>on</strong>.<br />

In cases that documentati<strong>on</strong>s are not turned <strong>in</strong> to <strong>the</strong> Nati<strong>on</strong>al <strong>Energy</strong> <strong>Authority</strong> with<strong>in</strong> <strong>the</strong> specified<br />

time limit, <strong>the</strong> <strong>Authority</strong> may impose daily f<strong>in</strong>es <strong>on</strong> <strong>the</strong> relevant company or <strong>in</strong>stituti<strong>on</strong>. The daily f<strong>in</strong>es<br />

may be <strong>in</strong> <strong>the</strong> range of ISK 10,000 to ISK 100,000. The party <strong>in</strong> questi<strong>on</strong> shall be notified of a decisi<strong>on</strong> to<br />

impose daily f<strong>in</strong>es by letter delivered <strong>in</strong> a verifiable manner. Decisi<strong>on</strong>s to impose daily f<strong>in</strong>es are<br />

enforceable by law, as is <strong>the</strong> cost of enforcement. Collected daily f<strong>in</strong>es shall accrue to <strong>the</strong> Treasury, net of<br />

collect<strong>in</strong>g costs.<br />

Article 3.

Article 4.<br />

The Nati<strong>on</strong>al <strong>Energy</strong> <strong>Authority</strong> shall make a strategic plan for <strong>the</strong> next four years c<strong>on</strong>cern<strong>in</strong>g <strong>the</strong> tasks<br />

set out for <strong>the</strong> <strong>Authority</strong> accord<strong>in</strong>g to items 2 and 3 of paragraph 1 <strong>in</strong> Article 2. The plan shall be reviewed<br />

every year and submitted to <strong>the</strong> M<strong>in</strong>ister for approval.<br />

Article 5.<br />

The M<strong>in</strong>ister appo<strong>in</strong>ts <strong>the</strong> director of <strong>the</strong> Nati<strong>on</strong>al <strong>Energy</strong> <strong>Authority</strong> for a term of five years at a time.<br />

His title is <strong>the</strong> Director General of <strong>the</strong> Nati<strong>on</strong>al <strong>Energy</strong> <strong>Authority</strong>. The Director General manages <strong>the</strong> work<br />

and daily operati<strong>on</strong> of <strong>the</strong> <strong>Authority</strong>. The Director General hires o<strong>the</strong>r pers<strong>on</strong>nel of <strong>the</strong> <strong>Authority</strong>.<br />

Article 6.<br />

The Nati<strong>on</strong>al <strong>Energy</strong> Council shall be operated at <strong>the</strong> Nati<strong>on</strong>al <strong>Energy</strong> <strong>Authority</strong>. The M<strong>in</strong>ister<br />

appo<strong>in</strong>ts <strong>the</strong> Council c<strong>on</strong>sist<strong>in</strong>g of five pers<strong>on</strong>s for a period of four years at a time. The ma<strong>in</strong> roles of <strong>the</strong><br />

Council shall i.a. be advis<strong>in</strong>g <strong>the</strong> implementati<strong>on</strong> of tasks accord<strong>in</strong>g to item 2 of paragraph 1 <strong>in</strong> Article 2, as<br />

well as present<strong>in</strong>g proposals and recommendati<strong>on</strong>s to <strong>the</strong> M<strong>in</strong>ister regard<strong>in</strong>g loan grants and disbursements<br />

made by <strong>the</strong> Nati<strong>on</strong>al <strong>Energy</strong> Fund. The M<strong>in</strong>ister may by means of Regulati<strong>on</strong>s lay down fur<strong>the</strong>r rules <strong>on</strong><br />

<strong>the</strong> organisati<strong>on</strong> and activities of <strong>the</strong> Council.<br />

Article 7.<br />

Whenever an energy related project is underway, which has been prepared by research and plann<strong>in</strong>g<br />

funded by <strong>the</strong> State, <strong>the</strong> developer <strong>in</strong>volved shall reimburse <strong>the</strong> Nati<strong>on</strong>al <strong>Energy</strong> <strong>Authority</strong> any verifiable<br />

costs, when issued an utilisati<strong>on</strong>- and/or a power development license. Expenses shall be extrapolated with<br />

<strong>the</strong> c<strong>on</strong>sumer price <strong>in</strong>dex through <strong>the</strong> payment due date. The Nati<strong>on</strong>al <strong>Energy</strong> <strong>Authority</strong> shall submit a<br />

statement with <strong>the</strong> reas<strong>on</strong><strong>in</strong>g for each reimbursement claim. In <strong>the</strong> event of a dispute c<strong>on</strong>cern<strong>in</strong>g such<br />

payments, <strong>the</strong> dispute shall be resolved by <strong>the</strong> assessment of arbitrati<strong>on</strong> of three pers<strong>on</strong>s, ei<strong>the</strong>r by <strong>the</strong><br />

demand of <strong>on</strong>e party <strong>in</strong>volved or both, <strong>on</strong> <strong>the</strong> ground of <str<strong>on</strong>g>Act</str<strong>on</strong>g> <str<strong>on</strong>g>No</str<strong>on</strong>g> 53/1989, <strong>on</strong> C<strong>on</strong>tractual Arbitrati<strong>on</strong>. The<br />

reimbursement shall be c<strong>on</strong>cluded <strong>in</strong> full no later than seven years follow<strong>in</strong>g <strong>the</strong> license issue date. The<br />

reimbursements shall be used to f<strong>in</strong>ance research <strong>on</strong> energy resources <strong>in</strong> <strong>Iceland</strong> which are carried out<br />

accord<strong>in</strong>g to item 2 of paragraph 1 <strong>in</strong> Article 2.<br />

Article 8.<br />

The Nati<strong>on</strong>al <strong>Energy</strong> Fund is property of <strong>the</strong> State, which is resp<strong>on</strong>sible for <strong>the</strong> Fund’s obligati<strong>on</strong>s.<br />

The M<strong>in</strong>ister of Industry, <strong>Energy</strong> and Tourism supervises <strong>the</strong> Nati<strong>on</strong>al <strong>Energy</strong> Fund. The Nati<strong>on</strong>al <strong>Energy</strong><br />

<strong>Authority</strong> manages <strong>the</strong> daily activities of <strong>the</strong> Fund.<br />

The role of <strong>the</strong> Nati<strong>on</strong>al <strong>Energy</strong> Fund is to develop <strong>the</strong> ec<strong>on</strong>omic exploitati<strong>on</strong> of <strong>the</strong> country’s energy<br />

resources by offer<strong>in</strong>g grants or loans, particularly to measures that aim to decrease <strong>the</strong> use of fossil fuels.<br />

These measures are to be achieved by:<br />

1. Offer<strong>in</strong>g loans for <strong>the</strong> explorati<strong>on</strong> of geo<strong>the</strong>rmal resources <strong>in</strong> cases where it could reduce <strong>the</strong><br />

publics’ cost of home heat<strong>in</strong>g<br />

2. Offer<strong>in</strong>g grants or venture loans for <strong>the</strong> design or c<strong>on</strong>structi<strong>on</strong> of orig<strong>in</strong>al <strong>in</strong>struments and<br />

equipment used for research <strong>on</strong> and exploitati<strong>on</strong> of energy resources<br />

3. Offer<strong>in</strong>g grants for special projects <strong>in</strong> <strong>the</strong> field of ec<strong>on</strong>omical energy utilisati<strong>on</strong>, <strong>in</strong>clud<strong>in</strong>g<br />

educati<strong>on</strong>al and outreach purposes<br />

4. Offer<strong>in</strong>g grants for projects that promote <strong>the</strong> exploitati<strong>on</strong> of domestic energy resources <strong>in</strong>stead<br />

of fossil fuels and streng<strong>the</strong>n <strong>in</strong>ternati<strong>on</strong>al cooperati<strong>on</strong> <strong>in</strong> such projects<br />

The Nati<strong>on</strong>al <strong>Energy</strong> Fund is not authorised to use its funds to offer grants or loans to <strong>the</strong> Nati<strong>on</strong>al<br />

<strong>Energy</strong> <strong>Authority</strong>.<br />

The Nati<strong>on</strong>al <strong>Energy</strong> Fund draws revenue from:<br />

1. Interest <strong>in</strong>come from <strong>the</strong> Fund’s m<strong>on</strong>ey<br />

2. Yearly state budget appropriati<strong>on</strong>s.<br />

It is permissible to enter <strong>in</strong>to agreements with parties that have statutory authorisati<strong>on</strong> to keep and<br />

manage funds <strong>in</strong> trust.<br />

The Nati<strong>on</strong>al <strong>Energy</strong> Council shall make proposals to <strong>the</strong> M<strong>in</strong>ister regard<strong>in</strong>g <strong>the</strong> grant<strong>in</strong>g of loans and<br />

disbursements from <strong>the</strong> Nati<strong>on</strong>al <strong>Energy</strong> Fund <strong>in</strong> accordance with <strong>the</strong> Fund’s budget and payment plans.

The M<strong>in</strong>ister shall, by means of a Regulati<strong>on</strong>, lay down fur<strong>the</strong>r requirements c<strong>on</strong>cern<strong>in</strong>g c<strong>on</strong>tributi<strong>on</strong>s<br />

from <strong>the</strong> Fund, preparati<strong>on</strong> for c<strong>on</strong>tributi<strong>on</strong>s, <strong>the</strong> grant<strong>in</strong>g of loans, <strong>in</strong>cl. <strong>in</strong>terests and o<strong>the</strong>r loan terms,<br />

payments, supervisi<strong>on</strong> of projects funded by <strong>the</strong> Fund and authorisati<strong>on</strong> to cancel <strong>the</strong> repayment of loans.<br />

Article 9.<br />

The M<strong>in</strong>ister is authorised to lay down fur<strong>the</strong>r provisi<strong>on</strong>s for <strong>the</strong> implementati<strong>on</strong> of this <str<strong>on</strong>g>Act</str<strong>on</strong>g> and <strong>the</strong><br />

operati<strong>on</strong> of <strong>the</strong> Nati<strong>on</strong>al <strong>Energy</strong> <strong>Authority</strong> by means of a Regulati<strong>on</strong><br />

This <str<strong>on</strong>g>Act</str<strong>on</strong>g> is effective immediately [...].<br />

Article 10.<br />

Interim provisi<strong>on</strong>s<br />

I.<br />

The M<strong>in</strong>ister of Industry, <strong>Energy</strong> and Tourism shall decide, after c<strong>on</strong>sult<strong>in</strong>g with <strong>the</strong> Nati<strong>on</strong>al <strong>Energy</strong><br />

<strong>Authority</strong> and <strong>Iceland</strong> GeoSurvey, which assets and debts of <strong>the</strong> Nati<strong>on</strong>al <strong>Energy</strong> <strong>Authority</strong> shall bel<strong>on</strong>g to<br />

each <strong>in</strong>stituti<strong>on</strong>. However, all research results and datasets which have been funded by public fund<strong>in</strong>g shall<br />

c<strong>on</strong>t<strong>in</strong>ue to be <strong>the</strong> property of <strong>the</strong> Nati<strong>on</strong>al <strong>Energy</strong> <strong>Authority</strong>.<br />
