HORRY COUNTY BUSINESS LICENSE<br />
ORDINANCE NUMBER 88-99<br />
Section 1.<br />
<strong>License</strong> Required<br />
Every person engaged or intending to engage in any calling,<br />
business, occupation or profession listed in the rate classification index<br />
portion of this ordinance, in whole or in part, within the unincorporated<br />
areas of the <strong>County</strong> of <strong>Horry</strong>, South Carolina, is required to pay an<br />
annual license fee and obtain a business license as herein provided.<br />
Section 2.<br />
Definitions<br />
The following words, terms and phrases, when used in this<br />
ordinance, shall have the meaning ascribed herein:<br />
A. “<strong>Business</strong>” means a trade, calling, occupation,<br />
profession, or activity engaged in with the object of gain, benefit or<br />
advantage, either directly or indirectly. A charitable organization shall be<br />
deemed a business unless the entire proceeds of its operations are<br />
devoted to charitable causes. A corporation or other legal person<br />
exempt from taxation pursuant to South Carolina Code § 33-35-10<br />
through § 33-35-170 (nonprofit corporations organized for the purpose of<br />
providing water supply and sewage disposal or a combination of those<br />
services) or a legal person exempt from income taxes pursuant to South<br />
Carolina Code § 33-49-120 shall not be deemed to be a “<strong>Business</strong>” for<br />
the purpose of this Ordinance.<br />
B. “<strong>County</strong>” means the <strong>County</strong> of <strong>Horry</strong>.<br />
C. “Classification” means that division of businesses by<br />
major groups subject to the same license rate as determined by a<br />
calculated index of ability to pay based on national averages, benefits,<br />
equalization of tax burden, relationships of services, or other basis<br />
deemed appropriate by <strong>Horry</strong> <strong>County</strong> Council.<br />
“Employee” shall mean any person who works for wages or salary, has<br />
the proper deductions for FICA, state, and federal taxes withheld by the<br />
employer, and receives a W-2 from the employer annually for all work<br />
done on the employer’s behalf.<br />
