GT Kontiki 2 (two) Year Warranty Seller warrants that its products sold hereunder at the time of shipment be free and clear of all encumbrances and will be free from defects in material and workmanship and will conform to the Seller’s applicable specifications or, if appropriate, to the Buyers specification accepted in writing. If products sold hereunder are not as warranted, Seller shall, at its option, refund the purchase price, repair, or replace the product, provided proof of purchase and written notice of non-conformance is received by seller within two (2) year from date of purchase. Upon verification by Seller that the product does not conform to this warranty, Seller will pay the cost of return transportation of such repaired or replacement goods to buyer. This warranty shall not apply to any products Seller determines have been, by Buyer or otherwise, subjected to dis-assembly, mishandling, misuse, neglect, ingress of water (flooding), improper testing, repair, alteration, damage, assembly or processing that alters physical or electrical properties. This warranty excludes all costs of shipping, customs clearance and related charges outside of New Zealand. Batteries and Strobe Assembly are specifically excluded from the two (2) year warranty due to potential adverse cycle and charging variations. Batteries and Strobe Assembly carry a one (1) year warranty from date of purchase. IN NO EVENT WILL SELLER BE LIABLE FOR ANY INJURIES INCURRED, INCIDENTAL OR CONSEQUENTIAL DAMAGES. THIS WARRANTY EXTENDS TO INITIAL BUYER ONLY AND NOT TO IN SUBSEQUENT BUYER’S CUSTOMERS AND IS IN LIEU OF OTHER WARRANTIES WHETHER EXPESS, IMPLIED OR STATUTORY INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS.
