4. Resident’s shall pay to the <strong>Authority</strong> all court costs, reasonable attorney’s fees<br />
and other expenses in enforcing or defending the Lease, and in recovering<br />
possession of the premises, unless resident’s prevails in such legal action.<br />
5. If the resident is entitled to and begins proceedings under the Grievance<br />
Procedure, eviction will not occur until a decision on the grievance is rendered.<br />
G. Records Management<br />
1. All criminal records received will be maintained confidentially, not misused, or<br />
improperly disseminated, and the utmost security will be maintained.<br />
2. All criminal records, while needed, will be housed in a locked file with access<br />
restricted to individuals responsible for screening and determining eligibility and<br />
to the CEO<br />
3. Misuse of the above information by any employee will grounds for discipline.<br />
Legal penalties for misuse are contained in Section 411.085 of the Texas<br />
Government Code.<br />
4. The criminal history record shall be shredded after the final determination is<br />
made.<br />
5. The <strong>Authority</strong> will document in the outcome in the file.<br />
