60 months for all other terminations<br />

v. The applicant must not have had an application for housing<br />

with the SAHA denied within the last 12 months, or have<br />

had an application withdrawn from the waiting list within the<br />

last six months.<br />

7. The <strong>Authority</strong> shall prohibit admission to any household that<br />

includes a member who is subject to any registration requirements<br />

under a state sex offender program. (Denial will not be limited to<br />

individuals with lifetime registration requirements)<br />

8. The <strong>Authority</strong> shall permanently prohibit admission to public<br />

housing if any household member has ever been convicted of<br />

drug-related criminal activity for manufacture or production of<br />

methamphetamine on the premises of federally assisted housing.<br />

D. Procedures for Applicant Screening<br />

1. Each household member age 17 or older at the time of application will sign a<br />

criminal history release form.<br />

2. The criminal history record will be reviewed to determine if any household<br />

member has a recent history or pattern of involvement with any of the above<br />

activity.<br />

3. If information is revealed in the criminal history record that would cause the<br />

<strong>Authority</strong> to deny housing to the household, the <strong>Authority</strong> shall provide a copy of<br />

the record to the person who applied as the head of household.<br />

4. If the applicant disputes the information in a timely manner, he/she shall be<br />

given an opportunity for an informal hearing for denials according to the Section<br />

XII of the <strong>Authority</strong>’s Admissions and Occupancy Policy.<br />

5. Where applicable, the <strong>Authority</strong> may waive its policy of prohibiting admission if<br />

the household member demonstrates to the <strong>Authority</strong>'s satisfaction that he/she<br />

is no longer engaging in illegal use of a controlled substance or abuse of alcohol<br />

and:<br />

a. Has successfully completed a supervised rehabilitation program;<br />

b. Has otherwise been rehabilitated successfully; or<br />

c. Is currently participating in a supervised rehabilitation program<br />

d. The circumstances which led to eviction no longer exist (e.g. the<br />

person involved in the criminal activity no longer lives in the household).<br />

e. The family includes a person with disabilities; the PHA’s decision<br />

concerning denial of admission is subject to consideration of reasonable<br />

accommodation in accordance with 24 CFR Part 8.<br />

6. Persons evicted from Public <strong>Housing</strong>, Indian <strong>Housing</strong>, Section 23 or any Section<br />
