22. Designated Family – The category of family for whom PHA elects (subject to HUD approval) to designate a<br />
development (e.g. elderly family in a development designated for elderly families) in accordance with the<br />
1992 <strong>Housing</strong> Act. (PL 96-120)<br />
23. Designated housing (or designated development) – A development(s), or portion of a development(s)<br />
designated for elderly only or for disabled families only in accordance with (PL 96-106).<br />
24. Development (504 Definition) – The whole of one or more residential structures and appurtenant structures, equipment,<br />
roads, walks and parking lots that are covered by a single contract for federal assistance or application for assistance,<br />
or are treated as a whole for processing purposes, whether or not on a common site. [24 CFR § 8.3]<br />
25. Disabled Family – A family whose head, spouse or sole member is a person with disabilities. (Person with<br />
disabilities is defined later in this section.) The term includes two or more persons with disabilities living<br />
together, and one or more such persons living with one or more persons including live-in aides determined to<br />
be essential to the care and well-being of the person or persons with disabilities. A disabled family may<br />
include persons with disabilities who are elderly. [24 CFR § 5.403]<br />
26. Displaced Person – A person displaced by government action or a person whose dwelling has been<br />
extensively damaged or destroyed as a result of a disaster declared or otherwise recognized pursuant to<br />
Federal disaster relief laws. This definition is used for eligibility determinations only. It should not be confused<br />
with the Federal preference for involuntary displacement. [(42 USC 1437a(b)(3)]<br />
27. Displacement Preference – An admissions preference awarded to applicants who can verify that they are or<br />
will be displaced by a natural disaster declared by the President of the United States, or by governmental<br />
action (e.g. an eminent domain taking, code enforcement action, etc.) or domestic violence.<br />
28. Divestiture Income – Imputed income from assets, including business assets, disposed of by applicant or<br />
resident in the last two years at less than fair market value. (See the definition of Net Family Assets [24 CFR §<br />
5.603] in this section.)<br />
29. Drug – A controlled substance as defined in the Controlled Substances Act. [24 CFR § 5.100]<br />
30. Drug Related Criminal Activity – The illegal manufacture, sale, distribution, or use of a drug, or the possession<br />
of a drug with intent to manufacture, sell, distribute or use the drug [as defined in Section 102 of the<br />
Controlled Substance Act (21 U.S.C. 802)]. The <strong>Authority</strong> considers an individual to have engaged in drugrelated<br />
activity if there is evidence of drug-related criminal activity, possession and/or use of narcotic<br />
paraphernalia (which did or did not result in an arrest and/or conviction). [24 CFR § 5.100]<br />
31. Domestic Violence – Includes felony or misdemeanor crimes Actual or threatened physical violence of a recent<br />
or continuous nature directed against one or more members of the applicant/resident’s family by a current or<br />
former spouse of the victim, by a person with whom the victim shares a child in common, by a person who is<br />
cohabitating with or has cohabitated with the victim as a spouse, by a person similarly situated to a spouse of<br />
the victim under the domestic or family violence laws of the jurisdiction receiving grant monies, or by any<br />
other person against an adult or youth victim who is protected from that person’s acts under the domestic or<br />
family violence laws of the jurisdiction.<br />
32. Due Process Determination – A determination by HUD that specified procedures for judicial eviction under<br />
State and local law require that a resident be given the opportunity for a hearing in court which provides the<br />
basic elements of due process before eviction from the unit. [24 CFR § 966.53]<br />
33. Elderly Family – A family whose head or spouse (or sole member) is at least 62 years of age. It may include<br />
two or more elderly persons living together, and one or more such persons living with one or more persons,<br />
including live-in aides, determined to be essential to the care and well-being of the elderly person or persons.<br />
An elderly family may include elderly persons with disabilities and other family members who are not elderly.<br />

34. Elderly Person – A person who is at least 62 years of age. [42 USC 1437a(b)(3)]<br />
