of the income disregarded, and Yr. 5: 10% of the income disregarded.<br />
There will be no “start-stop” for the disregard regardless of economic<br />
conditions (losing or gaining employment). Because this disregard<br />
allows the family to retain earnings immediately it will replace the FSS<br />
Escrow account. There will be no FSS escrow earned for families<br />
claiming the EID. For families already in the FSS program, any escrow<br />
earned will remain in the account and the family will be eligible for that<br />
amount when eligibility criteria for the escrow disbursement has been<br />
met under the current FSS program regulations.<br />
The head, co-head, or spouse can qualify the family for the disregard. To qualify the member<br />
must be previously unemployed. In addition, the FSS contract will require the family to be<br />
compliant with their Dwelling Lease Agreement throughout the contract period as well as<br />
complete the FDIC Money Smart Financial Literacy Education Program. Failure to meet<br />
these two criteria will result in loss of the EID.<br />
E. General Reexamination Procedures<br />
1. Residency Rule<br />
a. Beginning with the first annual reexaminations scheduled after October 2,<br />
1995, all residents were required to:<br />
i. Submit evidence of citizenship or eligible immigration status of<br />
all family members; or<br />
ii.<br />
Submit Certification that family members do not claim eligible<br />
immigration status or choose not to declare their immigration<br />
status.<br />
iii. This requirement shall occur once during continuous<br />
occupancy, except new family members must also provide the<br />
Certification(s) before entering the household.<br />
iv.<br />
The responsible adult must complete the Certification for newborn<br />
family members at the next annual or interim recertification.<br />
2. Disclosure of Assigned Social Security Numbers:<br />
a. As a condition of continued eligibility, any household member who is under<br />
the age of 62 as of January 31, 2010 and who claim legal residency or<br />
citizenship status must provide documentation of a Social Security Number if<br />
they have not previously done so.<br />
b. The <strong>Housing</strong> <strong>Authority</strong> will terminate the tenancy of any family who does not<br />
meet the applicable Social Security number disclosure, documentation, and<br />
verification, requirements set forth above. Termination may be deferred for up<br />
to 90 days due to unforeseen circumstances.<br />
3. Authorization for the Release of Information, Form HUD-9886 and Other<br />
Release Forms<br />
a. As a condition of continued eligibility, the resident, spouse, and for each<br />
member of the resident’s household who is 18 years of age or older must sign<br />
and submit a Form HUD-9886, “Authorization for the Release of Information”,<br />
and other release forms necessary to determine the family’s income and<br />
continued eligibility factors.<br />
4. Reexaminations<br />
a. At the time of reexamination, the head of the household will be required to<br />
submit an Application for Continued Occupancy along with verification and<br />
documentation of income, family composition, assets, and employment.<br />
b. Following receipt of this documentation, a determination of eligibility for<br />
continued occupancy will be made using the following criteria:<br />
i. The family must continue to qualify as a family as defined in<br />
CFR 24, Section 5.403, and outlined in Exhibit :1A.<br />
