The one adverse outcome to delivering the proposal would be the temporary<br />

restricted use <strong>of</strong> seven mobility parking spaces during construction, the loss <strong>of</strong> four<br />

spaces under the proposal and imposed time restrictions on an additional two spaces<br />

(refer to section 6.5.4). Transport for NSW is developing a kerbside allocation<br />

strategy in liaison with the City <strong>of</strong> Sydney Council to manage all parking changes<br />

(including mobility parking) occurring under this and the other Access Strategy<br />

projects.<br />

4.5 Confirmation <strong>of</strong> the statutory position<br />

4.5.1 Planning approval pathway<br />

Prior to determining whether to proceed with the activity as set out in the proposal,<br />

Roads and Maritime is required under Part 5 <strong>of</strong> the EP&A Act to ‘examine and take<br />

into account to the fullest extent possible all matters affecting, or likely to affect, the<br />

environment by reason <strong>of</strong> that activity’. This REF documents the required<br />

assessment <strong>of</strong> <strong>environmental</strong> impacts and describes measures proposed to mitigate<br />

any adverse impacts.<br />

The REF concludes that the proposal is unlikely to have a significant <strong>environmental</strong><br />

impact, with neither the local nor the cumulative impacts <strong>of</strong> this proposal deemed<br />

significant (refer to section 6.17). In addition, it would not affect any matters <strong>of</strong><br />

national <strong>environmental</strong> significance protected under the Commonwealth Government<br />

Environment Protection and Biodiversity Conservation Act 1999, or critical habitat,<br />

threatened species, populations, or communities listed under the NSW Threatened<br />

Species Conservation Act 1995 or the NSW Fisheries Management Act 1994.<br />

4.5.2 Additional approval and notification requirements<br />

In addition to the determination <strong>of</strong> this REF, Roads and Maritime would be required<br />

to undertake the following actions prior to construction:<br />

Secure ROLs under section 138 <strong>of</strong> the Roads Act 1993 for works affecting the<br />

classified roads listed in section 4.3.2<br />

Obtain approval, exemption and/or an excavation permit from the Heritage<br />

Council <strong>of</strong> NSW due to the proposal’s potential heritage impacts.<br />

Whilst certain legislative provisions do not apply to this proposal, Roads and Maritime<br />

has also committed to working closely with:<br />

CSTTC, to develop and <strong>review</strong> the proposal’s CTMP prior to construction<br />

starting onsite<br />

City <strong>of</strong> Sydney Council to ensure there is an integrated response to traffic<br />

management through the <strong>city</strong> <strong>centre</strong> over this period.<br />
