Roads and Maritime is, however, required to obtain a road occupancy licence (ROL)<br />

from the transport management <strong>centre</strong> (TMC) for the proposed works along the<br />

classified roads in the <strong>city</strong> <strong>centre</strong>, which for this proposal comprise:<br />

Precinct 2: retail:<br />

- R1(A) Park Street<br />

- R3(E) Sussex Street<br />

- R4(M) Clarence Street<br />

- R5(E) York Street<br />

Precinct 3: southern:<br />

- S4(A) Ultimo Road<br />

- S5(A-E) Broadway<br />

- S6(A) Pitt Street<br />

Precinct 4: college:<br />

- C2 (E) College Street.<br />

The ROL would allow the contractor to work within classified road corridor and<br />

implement agreed diversions, road closures and traffic management controls. Roads<br />

and Maritime would also work closely with City <strong>of</strong> Sydney Council before, during, and<br />

post-construction to ensure there is an integrated response to traffic management<br />

through the <strong>city</strong> <strong>centre</strong> over this period. This is discussed in Chapter 5.<br />

4.3.3 Protection <strong>of</strong> Environment Operations Act 1997 (as amended)<br />

Environmental protection is provisioned under the NSW Protection <strong>of</strong> the<br />

Environment Operations Act 1997. The underlying objective <strong>of</strong> the Act is to reduce<br />

pollution and manage the storage, treatment and disposal <strong>of</strong> waste.<br />

A key feature <strong>of</strong> the Act is the issuing <strong>of</strong> <strong>environmental</strong> protection licences (EPLs) for<br />

certain (scheduled) activities. Roads and Maritime is not required to obtain an EPL<br />

for this proposal, as it is not a scheduled activity. Specifically, it would not result in<br />

the construction <strong>of</strong> ‘a major road greater than one kilometre in length in a<br />

metropolitan area’ (refer to schedule 1(35) (2a) (i) <strong>of</strong> the Act).<br />

The Act does require Roads and Maritime to manage the proposal to limit its<br />

potential to cause water, noise and/or air pollution. Roads and Maritime is also<br />

required to manage the proposal’s waste streams. This would be achieved through<br />

implementing the safeguards and management measures identified in Chapter 7 <strong>of</strong><br />

this REF. Roads and Maritime is also required to notify the NSW Environment<br />

Protection Authority (EPA), which is responsible for administering the provisions <strong>of</strong><br />

the Act in instances where any pollution incident has the potential to ‘cause<br />

or threaten material harm to the environment’ (refer to section 148 <strong>of</strong> the act).<br />

4.3.4 Contaminated Land Management Act 1997<br />

The general objective <strong>of</strong> the Contaminated Land Management Act 1997 is to<br />

establish a process for investigating, and where appropriate, remediating land that is<br />

considered to pose a significant risk to human health or the environment. This Act<br />

requires Roads and Maritime to immediately notify the EPA if it suspected that the<br />

works have resulted in ground contamination or encountered/remobilised existing<br />

ground contamination. Section 6.8.3 discusses this further.<br />
