• When assessing a pers<strong>on</strong>’s ability to c<strong>on</strong>sent, it is important<br />

to distinguish between adults with learning disabilities’ sexual<br />

experience <strong>and</strong> their underst<strong>and</strong>ing <strong>of</strong> that experience; for<br />

example, people who are sexually abused may come to c<strong>on</strong>sider<br />

this as a normal part <strong>of</strong> their life.<br />

• Not knowing what is legal <strong>and</strong> illegal leaves people very<br />

vulnerable to exploitati<strong>on</strong>, as they can easily be deceived into<br />

thinking that certain acts are normally accepted, when in<br />

fact most society regards them as c<strong>on</strong>travening important<br />

boundaries.<br />

• People with learning disabilities also need to know what is<br />

c<strong>on</strong>sidered usual <strong>and</strong> unusual sexual behaviour.<br />

In relati<strong>on</strong> to the definiti<strong>on</strong> <strong>of</strong> capacity to c<strong>on</strong>sent to sexual intercourse,<br />

or activities short <strong>of</strong> intercourse, at minimum it has been suggested<br />

that a level <strong>of</strong> underst<strong>and</strong>ing <strong>of</strong> the sexual act is required (Evans <strong>and</strong><br />

Rodgers, 2000). The questi<strong>on</strong> <strong>of</strong> whether the law should impose a<br />

greater level <strong>of</strong> underst<strong>and</strong>ing, for example, that <strong>of</strong> underst<strong>and</strong>ing the<br />

possible c<strong>on</strong>sequences, such as pregnancy or the risk <strong>of</strong> c<strong>on</strong>tracting<br />

sexually transmitted diseases, has been examined. The former, the<br />

simple fact <strong>of</strong> underst<strong>and</strong>ing the sex act, is a lower st<strong>and</strong>ard, <strong>and</strong> would<br />

enable some individuals to c<strong>on</strong>sent to sex. A higher st<strong>and</strong>ard, that <strong>of</strong><br />

underst<strong>and</strong>ing the sexual act <strong>and</strong> its c<strong>on</strong>sequences, would restrict the<br />

ability <strong>of</strong> many intellectually disabled adults to c<strong>on</strong>sent but would provide
