the Mental Capacity Act 2005, does not cover people who lack capacity<br />

to c<strong>on</strong>sent to have sexual relati<strong>on</strong>s, as it was c<strong>on</strong>sidered that such a<br />

decisi<strong>on</strong> was so pers<strong>on</strong>al to the individual c<strong>on</strong>cerned that it could not be<br />

made <strong>on</strong> behalf <strong>of</strong> a pers<strong>on</strong>.<br />

McCarthy <strong>and</strong> Thomps<strong>on</strong> (2004) state that in the learning disability field,<br />

people must have free choice <strong>and</strong> informed c<strong>on</strong>sent when it comes to<br />

sexual relati<strong>on</strong>ships. They c<strong>on</strong>sidered that the c<strong>on</strong>diti<strong>on</strong>s that should<br />

exist for free choice included the following:<br />

• For valid c<strong>on</strong>sent to sex, women with learning disabilities must<br />

know that sex, especially when initiated by a more powerful<br />

pers<strong>on</strong>, is not required <strong>and</strong> compulsory.<br />

• People must have sufficient communicati<strong>on</strong> skills to be able to<br />

make their choice (to engage in sexual activity or not) known to<br />

the other party. This means that either verbally or through an<br />

alternative communicati<strong>on</strong> system known to both parties they<br />

must be able to give/deny/withdraw c<strong>on</strong>sent at any stage in the<br />

activity. Silence or n<strong>on</strong>-communicati<strong>on</strong> must not be interpreted<br />

as c<strong>on</strong>sent.<br />

62 The Criminal Law (Sexual Offences) Act 2006 established a comm<strong>on</strong> age <strong>of</strong><br />

c<strong>on</strong>sent to sex at 17 for males <strong>and</strong> females, whether it is a heterosexual or<br />

homosexual relati<strong>on</strong>ship.
