Functi<strong>on</strong>al approach is based <strong>on</strong> establishing (1) a pers<strong>on</strong>’s<br />

functi<strong>on</strong>al abilities, behaviours or capacities (Grisso, 1986),<br />

that is, what he or she underst<strong>and</strong>s, knows, believes or can do<br />

which is directly relevant to the legal c<strong>on</strong>text at issue <strong>and</strong> (2) the<br />

extent to which these functi<strong>on</strong>al abilities meet the dem<strong>and</strong>s <strong>of</strong> a<br />

particular situati<strong>on</strong> within a given legal c<strong>on</strong>text.<br />

Experiencing Crisis Pregnancy<br />

According to Myr<strong>on</strong> et al. (2008) the functi<strong>on</strong>al approach has been<br />

increasingly preferred when assessing capacity <strong>and</strong> is increasingly<br />

recommended to pr<strong>of</strong>essi<strong>on</strong>als such as medical practiti<strong>on</strong>ers <strong>and</strong><br />

psychologists in their pr<strong>of</strong>essi<strong>on</strong>al guidance. [61]<br />

The implicati<strong>on</strong> is that before making any declarati<strong>on</strong> <strong>of</strong> incapacity,<br />

c<strong>on</strong>siderati<strong>on</strong> needs to be given to whether it would be possible either<br />

to improve the pers<strong>on</strong>’s relevant functi<strong>on</strong>al abilities (for example, by<br />

ensuring that he/she is <strong>of</strong>fered educati<strong>on</strong> or additi<strong>on</strong>al support) <strong>and</strong>/<br />

or to simplify or otherwise amend the situati<strong>on</strong> to improve the pers<strong>on</strong>’s<br />

capacity (Murphy <strong>and</strong> Clare, 2003).<br />

Brown (2004: 44) critiques the functi<strong>on</strong>al model <strong>and</strong> argues that it<br />

tends not to explore suggestibility <strong>and</strong> the effect <strong>of</strong> gendered power<br />

<strong>and</strong> stereotypical gender roles <strong>on</strong> the ability <strong>of</strong> women with learning<br />

disabilities to make sound <strong>and</strong> safe decisi<strong>on</strong>s in their relati<strong>on</strong>ships <strong>and</strong><br />

sexual lives. She suggests that a model <strong>of</strong> capacity should both maximise<br />

the woman’s involvement in decisi<strong>on</strong>-making <strong>and</strong>, when it comes to<br />

serious abuses, help her to seek refuge, justice <strong>and</strong> redress (Brown,<br />

2004).<br />

3.6 Setting the st<strong>and</strong>ard for determining capacity to c<strong>on</strong>sent<br />

to sexual relati<strong>on</strong>ships<br />

Much research <strong>on</strong> decisi<strong>on</strong>-making capacity has c<strong>on</strong>cerned c<strong>on</strong>sent to<br />

treatment (Grisso & Appelbaum, 1998; Arscott, Dagnan <strong>and</strong> Stenfert<br />

Kroese, 1999; W<strong>on</strong>g, Clare, Holl<strong>and</strong>, Wats<strong>on</strong> <strong>and</strong> Gunn, 2000). Murphy<br />
