<strong>and</strong> <strong>Appropriate</strong> <strong>of</strong> Provisi<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>Review</str<strong>on</strong>g> <str<strong>on</strong>g>Literature</str<strong>on</strong>g><br />

Experiencing Crisis Pregnancy<br />

• The right to be recognised as a pers<strong>on</strong> before the law. [53]<br />

• The right to freedom from discriminati<strong>on</strong> <strong>on</strong> the grounds <strong>of</strong><br />

disability [54] <strong>and</strong> the right to reas<strong>on</strong>able accommodati<strong>on</strong> by the<br />

provisi<strong>on</strong> <strong>of</strong> special facilities <strong>and</strong> treatment.<br />

• The requirement that States take appropriate measures to<br />

provide pers<strong>on</strong>s with disabilities with access to the support they<br />

may require in exercising their legal capacity. [55]<br />

• The recogniti<strong>on</strong> <strong>and</strong> protecti<strong>on</strong> <strong>of</strong> the rights <strong>of</strong> the pers<strong>on</strong><br />

lacking capacity, including the recogniti<strong>on</strong> <strong>of</strong> the right to sexual<br />

expressi<strong>on</strong> for people with intellectual disabilities.<br />

• Emphasis <strong>on</strong> a woman’s abilities rather than her disabilities; her<br />

participati<strong>on</strong> in society should be encouraged notwithst<strong>and</strong>ing<br />

her lack <strong>of</strong> capacity in certain areas.<br />

• The promoti<strong>on</strong> <strong>of</strong> services that seek to integrate empowerment<br />

<strong>and</strong> protecti<strong>on</strong> within their approaches to supporting the sexual<br />

lives <strong>of</strong> people with intellectual disabilities.<br />

While the right to enter into a sexual relati<strong>on</strong>ship has not been enshrined<br />

in legislati<strong>on</strong>, both Irish case law <strong>and</strong> the C<strong>on</strong>venti<strong>on</strong> for the Protecti<strong>on</strong><br />

<strong>of</strong> Human Rights <strong>and</strong> Fundamental Freedoms (ECHR) go some way<br />
