treatment decisi<strong>on</strong>s; <strong>and</strong> a requirement that the pers<strong>on</strong> lacking<br />

capacity should be c<strong>on</strong>sulted regarding their choice <strong>of</strong> pers<strong>on</strong>al<br />

guardian (D<strong>on</strong>nelly, 2008).<br />

Internati<strong>on</strong>al legislati<strong>on</strong> governing capacity<br />

• In Engl<strong>and</strong> <strong>and</strong> Wales, the corresp<strong>on</strong>ding legislati<strong>on</strong> is the Mental<br />

Capacity Act, 2005, which provides a statutory framework for<br />

substitute decisi<strong>on</strong>-making for those who lack capacity. Many <strong>of</strong><br />

the provisi<strong>on</strong>s in the Scheme <strong>of</strong> Mental Capacity Bill, 2008, are<br />

similar to the provisi<strong>on</strong>s in this legislati<strong>on</strong>.<br />

• Good practice provisi<strong>on</strong>s <strong>of</strong> the UK’s Mental Capacity Act 2005<br />

were identified as follows:<br />

- It adopts a functi<strong>on</strong>al approach, where capacity is decisi<strong>on</strong>specific<br />

<strong>and</strong> time-specific rather than global or permanent;<br />

the implicati<strong>on</strong> is that before any declarati<strong>on</strong> <strong>of</strong> incapacity,<br />

c<strong>on</strong>siderati<strong>on</strong> needs to be given as to whether it would be<br />

possible either to improve the pers<strong>on</strong>’s relevant functi<strong>on</strong>al<br />

abilities <strong>and</strong>/or to simplify or otherwise amend the situati<strong>on</strong><br />

to improve the pers<strong>on</strong>’s capacity (Murphy <strong>and</strong> Clare, 2003).<br />

- It introduces a legal duty to c<strong>on</strong>sult with others involved in<br />

caring for the pers<strong>on</strong> or interested in his/her welfare before<br />

carrying out acts in relati<strong>on</strong> to a pers<strong>on</strong> who lacks capacity.<br />

- It requires steps to be taken to develop capacity <strong>and</strong> imports<br />

a right to comprehensible informati<strong>on</strong> (S. 1 (3); S 3 (2)).<br />

- Under the Act, a pers<strong>on</strong> is required to make an assessment<br />

<strong>of</strong> capacity before carrying out any care or treatment. The<br />
