been recognised that c<strong>on</strong>traceptive treatment should be treated<br />

in the same way as all other medical procedures, i.e. be subject<br />

to the same rules that apply for medical treatments in general<br />

(Namhi, 2003).<br />

<strong>and</strong> <strong>Appropriate</strong> <strong>of</strong> Provisi<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>Review</str<strong>on</strong>g> <str<strong>on</strong>g>Literature</str<strong>on</strong>g><br />

Experiencing Crisis Pregnancy<br />

• If the questi<strong>on</strong> <strong>of</strong> routine or minor procedures arises, then efforts<br />

should be made to ascertain if the pers<strong>on</strong> has capacity to decide.<br />

There is provisi<strong>on</strong> for informal decisi<strong>on</strong>-making for health care<br />

<strong>and</strong> treatment in the Scheme <strong>of</strong> Mental Capacity Bill, 2008. The<br />

High Court has exclusive jurisdicti<strong>on</strong> to determine any issues<br />

c<strong>on</strong>cerning a n<strong>on</strong>-therapeutic sterilisati<strong>on</strong> in the case <strong>of</strong> a pers<strong>on</strong><br />

who lacks decisi<strong>on</strong>-making capacity.<br />

Legislati<strong>on</strong> governing capacity<br />

• Within the Scheme <strong>of</strong> Mental Capacity Bill 2008 capacity<br />

is defined as ‘the ability to underst<strong>and</strong> the nature <strong>and</strong><br />

c<strong>on</strong>sequences <strong>of</strong> a decisi<strong>on</strong> in the c<strong>on</strong>text <strong>of</strong> available choices at<br />

the time the decisi<strong>on</strong> is to be made’. [51]<br />

• The draft Bill reflects the internati<strong>on</strong>al move towards a functi<strong>on</strong>al<br />

approach to capacity where a pers<strong>on</strong> lacks the capacity to make<br />

a decisi<strong>on</strong> if she/he is unable to:<br />

- Underst<strong>and</strong> the informati<strong>on</strong> relevant to the decisi<strong>on</strong>;<br />

- Retain that informati<strong>on</strong>;<br />

- Use or weigh that informati<strong>on</strong> as part <strong>of</strong> the process <strong>of</strong><br />

making the decisi<strong>on</strong>;<br />

- Communicate her/his decisi<strong>on</strong>.<br />

• Informal decisi<strong>on</strong>-making is provided for in the draft Bill, which<br />

gives medical practiti<strong>on</strong>ers <strong>and</strong> others who perform an act in<br />

c<strong>on</strong>necti<strong>on</strong> with the care or treatment <strong>of</strong> another pers<strong>on</strong> whose<br />

decisi<strong>on</strong>-making capacity is in doubt, immunity from liability<br />

if they comply with the c<strong>on</strong>diti<strong>on</strong>s in the draft legislati<strong>on</strong> when<br />

treating patients.<br />
