In the absence <strong>of</strong> explicit assessment guidelines, there is a danger that<br />

incapacity might be inferred solely <strong>on</strong> the grounds that the individual has<br />

a disabling medical or psychiatric c<strong>on</strong>diti<strong>on</strong>. The Ontario Ministry <strong>of</strong> the<br />

Attorney General (2005) states that the Substitute Decisi<strong>on</strong>s Act 1992<br />

created the opportunity for the introducti<strong>on</strong> <strong>of</strong> a st<strong>and</strong>ard assessment<br />

protocol, which would reduce bias <strong>and</strong> introduce c<strong>on</strong>sistency in the way<br />

that mental capacity assessments are c<strong>on</strong>ducted (Ontario Ministry <strong>of</strong> the<br />

Attorney General, 2005.) [46]<br />

Experiencing Crisis Pregnancy<br />

The Department <strong>of</strong> Health in the UK has published the ‘Good Practice in<br />

C<strong>on</strong>sent Implementati<strong>on</strong> Guide: c<strong>on</strong>sent to examinati<strong>on</strong> or treatment’<br />

(DH, 2001). The good practice in c<strong>on</strong>sent implementati<strong>on</strong> guide<br />

c<strong>on</strong>tains a model c<strong>on</strong>sent policy <strong>and</strong> four c<strong>on</strong>sent forms, together<br />

with an accompanying informati<strong>on</strong> leaflet. The model documentati<strong>on</strong><br />

was developed as part <strong>of</strong> the Department <strong>of</strong> Health’s ‘Good Practice in<br />

C<strong>on</strong>sent’ initiative, with the aim <strong>of</strong> assisting Nati<strong>on</strong>al Health Service<br />

(NHS) organisati<strong>on</strong>s to promote good practice in the way patients are<br />

asked to give their c<strong>on</strong>sent to treatment, care or research.<br />

Four c<strong>on</strong>sent forms were developed; the fourth <strong>on</strong>e is <strong>of</strong> particular<br />

relevance to staff working with people with learning disabilities (see<br />

Appendix A). It provides guidance <strong>on</strong> how an individual practiti<strong>on</strong>er might<br />

assess a pers<strong>on</strong>’s capacity <strong>and</strong> then decide, with support from others,<br />

whether it is in the pers<strong>on</strong>’s best interests to carry out the investigati<strong>on</strong><br />

or treatment. (See also the Mental Capacity Act 2005, Code <strong>of</strong> Practice<br />

for detailed guidance.)<br />

2.8.3 Supporting decisi<strong>on</strong>-making<br />

Hobden & Mills (2008) emphasise the need to properly assess the<br />

capacity <strong>of</strong> the individual in questi<strong>on</strong> to make his/her decisi<strong>on</strong> <strong>and</strong> to<br />

recognise that people with intellectual disabilities may have the capacity<br />

to both give <strong>and</strong> withhold c<strong>on</strong>sent to medical or surgical treatment.<br />

They note that the competent individual has the right to make the<br />

wr<strong>on</strong>g decisi<strong>on</strong>, even for reas<strong>on</strong>s that may be irrati<strong>on</strong>al or n<strong>on</strong>-existent<br />

to health pr<strong>of</strong>essi<strong>on</strong>als (Hobden & Mills, 2008). The mere presence <strong>of</strong><br />

emoti<strong>on</strong>al resp<strong>on</strong>ses such as that <strong>of</strong> panic or irrati<strong>on</strong>ality does not in<br />
