2.8.2 Assessment <strong>of</strong> capacity<br />

It is the resp<strong>on</strong>sibility <strong>of</strong> the relevant medical practiti<strong>on</strong>er to ensure<br />

that a pers<strong>on</strong> has capacity to make a healthcare decisi<strong>on</strong> (LRC, 2005).<br />

According to the Law Reform Commissi<strong>on</strong> the area <strong>of</strong> assessment<br />

<strong>of</strong> capacity to make healthcare decisi<strong>on</strong>s is fraught with uncertainty<br />

(2006: 31). Under current arrangements, health pr<strong>of</strong>essi<strong>on</strong>als have to<br />

exercise pers<strong>on</strong>al judgement in assessing capacity <strong>and</strong> determining<br />

how to proceed if an adult is assessed as lacking the capacity to make a<br />

healthcare decisi<strong>on</strong>. In n<strong>on</strong>-emergency situati<strong>on</strong>s (where the doctrine <strong>of</strong><br />

necessity is not applicable), healthcare pr<strong>of</strong>essi<strong>on</strong>als find themselves in a<br />

difficult positi<strong>on</strong> (LRC, 2006).<br />

The <strong>on</strong>ly pr<strong>of</strong>essi<strong>on</strong>al guidance available for Irish medical pr<strong>of</strong>essi<strong>on</strong>als<br />

is found in the Medical Council’s ‘A Guide to Ethical C<strong>on</strong>duct <strong>and</strong><br />

Behaviour’ (The Medical Council Irel<strong>and</strong>, 2004: 31), which states:<br />

Informed c<strong>on</strong>sent can <strong>on</strong>ly be obtained by a doctor who has<br />

sufficient training <strong>and</strong> experience to be able to explain the<br />

interventi<strong>on</strong>, the risks <strong>and</strong> benefits <strong>and</strong> the alternatives. In<br />

obtaining this c<strong>on</strong>sent the doctor must satisfy himself/herself<br />

that the patient underst<strong>and</strong>s what is involved by explaining in<br />

appropriate terminol ogy. A competent adult patient has the right<br />

to refuse treatment. While the deci si<strong>on</strong> must be respected, the<br />

assessment <strong>of</strong> competence <strong>and</strong> the discussi<strong>on</strong> <strong>on</strong> c<strong>on</strong>sent should<br />

be carried out in c<strong>on</strong>juncti<strong>on</strong> with a senior colleague.<br />

According to this guide, if a pers<strong>on</strong> with a disability lacks the capacity to<br />

give c<strong>on</strong>sent, a c<strong>on</strong>sultati<strong>on</strong> involving parents/guardians <strong>and</strong> appropriate<br />

carers should occur (The Medical Council, Irel<strong>and</strong>, 2004: 11).<br />

The Law Reform Commissi<strong>on</strong> (LRC) has recognised that practices have<br />

now become established such as seeking a signature <strong>on</strong> a c<strong>on</strong>sent form,<br />

which has no st<strong>and</strong>ing in law. The Law Reform Commissi<strong>on</strong> asserts that<br />

there is a need for guidance for medical practiti<strong>on</strong>ers in relati<strong>on</strong> to:<br />

• How capacity to make healthcare decisi<strong>on</strong>s should be assessed
