Secti<strong>on</strong>. 4 (1) defines capacity as follows:<br />

<str<strong>on</strong>g>Literature</str<strong>on</strong>g> <str<strong>on</strong>g>Review</str<strong>on</strong>g> <strong>on</strong> Provisi<strong>on</strong> <strong>of</strong> <strong>Appropriate</strong> <strong>and</strong> <strong>Accessible</strong><br />

Support to People with an Intellectual Disability who are<br />

A pers<strong>on</strong> is capable with respect to a treatment ... if the pers<strong>on</strong><br />

Experiencing Crisis Pregnancy<br />

is able to underst<strong>and</strong> the informati<strong>on</strong> that is relevant to making<br />

a decisi<strong>on</strong> about the treatment … <strong>and</strong> able to appreciate the<br />

reas<strong>on</strong>ably foreseeable c<strong>on</strong>sequences <strong>of</strong> a decisi<strong>on</strong> or lack <strong>of</strong><br />

decisi<strong>on</strong>.<br />

‘Treatment’ is defined (subject to significant exclusi<strong>on</strong>s) as anything that<br />

is d<strong>on</strong>e for a therapeutic, preventive, palliative, diagnostic, cosmetic or<br />

other health-related purpose, <strong>and</strong> includes a course <strong>of</strong> treatment, plan <strong>of</strong><br />

treatment or community treatment plan. Secti<strong>on</strong> 11 defines the elements<br />

required for c<strong>on</strong>sent to treatment as:<br />

1. must relate to the treatment<br />

2. must be informed<br />

3. must be given voluntarily<br />

4. must not have been obtained though misrepresentati<strong>on</strong> or fraud.<br />

Secti<strong>on</strong> 11 (2) states that informed c<strong>on</strong>sent requires the pers<strong>on</strong> to<br />

have received informati<strong>on</strong> that a reas<strong>on</strong>able pers<strong>on</strong> in the same<br />

circumstances would require about:<br />

1. The nature <strong>of</strong> the treatment<br />

2. The expected benefits <strong>of</strong> the treatment<br />

3. The material risks <strong>of</strong> the treatment<br />

4. The material side-effects <strong>of</strong> the treatment<br />

5. Alternative courses <strong>of</strong> acti<strong>on</strong><br />

6. The likely c<strong>on</strong>sequences <strong>of</strong> not having the treatment.<br />

Secti<strong>on</strong> 11 (2) also states that informed c<strong>on</strong>sent requires that the pers<strong>on</strong><br />

has received resp<strong>on</strong>ses to his or her requests for additi<strong>on</strong>al informati<strong>on</strong><br />

about those matters listed above.<br />

The Health Care C<strong>on</strong>sent Act 1996 also c<strong>on</strong>tains the principle <strong>of</strong><br />

‘presumpti<strong>on</strong> <strong>of</strong> capacity’, with an excepti<strong>on</strong> in the case where a pers<strong>on</strong>
