Safeguards<br />

Safeguards are provided in the legislati<strong>on</strong>, i.e. it cannot be decided that<br />

some<strong>on</strong>e lacks capacity based <strong>on</strong> their age, appearance, c<strong>on</strong>diti<strong>on</strong> or<br />

behaviour al<strong>on</strong>e.<br />

Advocacy structure<br />

The Act provides for an Independent Mental Capacity Advocate (IMCA)<br />

service, the aim <strong>of</strong> which is to provide independent safeguards for people<br />

who lack capacity to make certain important decisi<strong>on</strong>s about serious<br />

medical treatment <strong>and</strong> changes <strong>of</strong> accommodati<strong>on</strong> <strong>and</strong>, at the time such<br />

decisi<strong>on</strong>s need to be made, have no family or friends that it would be<br />

appropriate to c<strong>on</strong>sult. An IMCA may be c<strong>on</strong>sulted to support some<strong>on</strong>e<br />

who lacks capacity to make decisi<strong>on</strong>s c<strong>on</strong>cerning care reviews <strong>and</strong> adult<br />

protecti<strong>on</strong> cases.<br />

2.7.2 Legal capacity in Canada<br />

In Ontario, Canada, the relevant statute in this area is the Health Care<br />

C<strong>on</strong>sent Act 1996, which covers treatment, admissi<strong>on</strong> into a l<strong>on</strong>g-term<br />

facility, <strong>and</strong> decisi<strong>on</strong>s about pers<strong>on</strong>al assistance services. Mental<br />

Capacity is a legal c<strong>on</strong>struct <strong>and</strong> means the ability to firstly ‘underst<strong>and</strong>’
