Legal duty to c<strong>on</strong>sult with others<br />

The Act places a duty <strong>on</strong> the decisi<strong>on</strong>-maker to c<strong>on</strong>sult other people<br />

close to a pers<strong>on</strong> who lacks capacity, where practical <strong>and</strong> appropriate,<br />

<strong>on</strong> decisi<strong>on</strong>s <str<strong>on</strong>g>Literature</str<strong>on</strong>g> affecting <str<strong>on</strong>g>Review</str<strong>on</strong>g> the pers<strong>on</strong> Provisi<strong>on</strong> <strong>and</strong> what <strong>of</strong> <strong>Appropriate</strong> might be in <strong>and</strong> the <strong>Accessible</strong> pers<strong>on</strong>’s best<br />

interests (Bartlett, Support 2008). to People In particular, with an Intellectual under Secti<strong>on</strong> Disability 4 (7) who the are decisi<strong>on</strong>maker<br />

has a duty to take into account the views <strong>of</strong> people including:<br />

Experiencing Crisis Pregnancy<br />

any<strong>on</strong>e the pers<strong>on</strong> has previously named as some<strong>on</strong>e they want to be<br />

c<strong>on</strong>sulted; any<strong>on</strong>e involved in caring for the pers<strong>on</strong>; any<strong>on</strong>e interested<br />

in their welfare (for example, family carers, other close relatives, or an<br />

advocate already working with the pers<strong>on</strong>) (Bartlett, 2008).<br />

Recogniti<strong>on</strong> <strong>of</strong> the c<strong>on</strong>tingent nature <strong>of</strong> incapacity<br />

Recognises the c<strong>on</strong>tingent nature <strong>of</strong> incapacity <strong>and</strong> requires assessors<br />

to go bey<strong>on</strong>d simply assessing capacity <strong>and</strong> to take steps to develop<br />

capacity. Secti<strong>on</strong> 1 (3) states that a pers<strong>on</strong> is not to be treated as unable<br />

to make a decisi<strong>on</strong> unless ‘all practicable steps to help the pers<strong>on</strong> have<br />

been taken without success’. Secti<strong>on</strong> 3 (2) provides that a pers<strong>on</strong> is not to<br />

be regarded as unable to underst<strong>and</strong> relevant informati<strong>on</strong> if the pers<strong>on</strong><br />

‘is able to underst<strong>and</strong> an explanati<strong>on</strong> <strong>of</strong> it given to him in a way that is<br />

appropriate to his circumstances’. (There are equivalent provisi<strong>on</strong>s in the<br />

Scheme <strong>of</strong> Mental Capacity Bill 2008.) Thus, according to D<strong>on</strong>nelly (2008),<br />

the Mental Capacity Act 2005 requires steps to be taken <strong>and</strong> imports<br />

a right to comprehensible informati<strong>on</strong> into the statutory definiti<strong>on</strong> <strong>of</strong><br />

capacity.<br />

Assessment <strong>of</strong> capacity<br />

Under the Mental Capacity Act 2005, a pers<strong>on</strong> is required to make an<br />

assessment <strong>of</strong> capacity before carrying out any care or treatment. The<br />

more serious the decisi<strong>on</strong>, the more formal the assessment will need to<br />

be. (See Chapter 4 <strong>of</strong> the Mental Capacity Code <strong>of</strong> Practice.)<br />

Best interests st<strong>and</strong>ard<br />

The Act requires people to follow certain steps to help them work out<br />

whether a particular act or decisi<strong>on</strong> is in a pers<strong>on</strong>’s best interests.<br />

Where the pers<strong>on</strong> who acts or makes the decisi<strong>on</strong> has followed the steps<br />

to establish whether a pers<strong>on</strong> has capacity <strong>and</strong> d<strong>on</strong>e everything they
