Functi<strong>on</strong>al approach<br />

The Mental Capacity Act adopts a functi<strong>on</strong>al approach based <strong>on</strong><br />

establishing the extent to which the pers<strong>on</strong>’s underst<strong>and</strong>ing, knowledge,<br />

skills <strong>and</strong> abilities meet the dem<strong>and</strong>s <strong>of</strong> the task involved in making<br />

that particular decisi<strong>on</strong> within a given legal c<strong>on</strong>text (Grisso, 1986). Any<br />

assessment <strong>of</strong> a pers<strong>on</strong>’s capacity must be ‘decisi<strong>on</strong>-specific’, meaning<br />

that it must be about the particular decisi<strong>on</strong> that has to be made at a<br />

particular time <strong>and</strong> is not about a range <strong>of</strong> decisi<strong>on</strong>s; capacity is decisi<strong>on</strong><br />

<strong>and</strong> time specific, rather than global or permanent. Under the functi<strong>on</strong>al<br />

approach to capacity, a new assessment <strong>of</strong> capacity is required for each<br />

new decisi<strong>on</strong> or task (D<strong>on</strong>nelly, 2007). Just because a pers<strong>on</strong> may lack<br />

capacity to make a decisi<strong>on</strong> <strong>on</strong> <strong>on</strong>e occasi<strong>on</strong> does not mean that they will<br />

never have capacity to make a decisi<strong>on</strong> in the future about a different<br />

matter; if some<strong>on</strong>e cannot make complex decisi<strong>on</strong>s, this does not mean<br />

that they cannot make simple decisi<strong>on</strong>s.<br />

The implicati<strong>on</strong> is that before making any declarati<strong>on</strong> <strong>of</strong> incapacity,<br />

c<strong>on</strong>siderati<strong>on</strong> needs to be given as to whether it would be possible either<br />

to improve the pers<strong>on</strong>’s relevant functi<strong>on</strong>al abilities (for example, by<br />

ensuring that he/she is <strong>of</strong>fered educati<strong>on</strong> or additi<strong>on</strong>al support) <strong>and</strong>/<br />

or to simplify or otherwise amend the situati<strong>on</strong> to improve the pers<strong>on</strong>’s<br />

capacity (Murphy <strong>and</strong> Clare, 2003). According to Myr<strong>on</strong>, Gillespie, Swift<br />

<strong>and</strong> Williams<strong>on</strong> (2008) a functi<strong>on</strong>al approach has been increasingly<br />

preferred when assessing capacity <strong>and</strong> recommended to pr<strong>of</strong>essi<strong>on</strong>als<br />

such as medical practiti<strong>on</strong>ers <strong>and</strong> psychologists in their pr<strong>of</strong>essi<strong>on</strong>al<br />

guidance. [40]<br />
