requirement to obtain the c<strong>on</strong>sent <strong>of</strong> the ‘pers<strong>on</strong> resp<strong>on</strong>sible’<br />

for the pers<strong>on</strong> lacking capacity. The inclusi<strong>on</strong> <strong>of</strong> such a special<br />

provisi<strong>on</strong> requiring c<strong>on</strong>sent to medical treatment, even in relati<strong>on</strong><br />

to ‘routine’ procedures, provides a better degree <strong>of</strong> protecti<strong>on</strong><br />

for people lacking capacity. She argues that while most medical<br />

pr<strong>of</strong>essi<strong>on</strong>als undoubtedly include the family members or<br />

carers <strong>of</strong> a pers<strong>on</strong> lacking capacity in treatment decisi<strong>on</strong>s,<br />

the legislati<strong>on</strong> should include a specific provisi<strong>on</strong> requiring<br />

them to do so. Part 5 <strong>of</strong> the New South Wales Guardianship Act<br />

1987 c<strong>on</strong>tains a requirement in relati<strong>on</strong> to medical <strong>and</strong> dental<br />

treatment, whereby the c<strong>on</strong>sent <strong>of</strong> the ’pers<strong>on</strong> resp<strong>on</strong>sible’ for<br />

the pers<strong>on</strong> lacking capacity is required. [37]<br />

• A requirement that the pers<strong>on</strong> lacking capacity should be<br />

c<strong>on</strong>sulted regarding the choice <strong>of</strong> pers<strong>on</strong>al guardian should be<br />

included in the legislati<strong>on</strong>.<br />

2.7 Legal capacity in other jurisdicti<strong>on</strong>s<br />

Different jurisdicti<strong>on</strong>s have their own legal process for substitute<br />

decisi<strong>on</strong>-making in situati<strong>on</strong>s where a pers<strong>on</strong> with an intellectual<br />

disability lacks the capacity to c<strong>on</strong>sent.<br />

2.7.1 Legal capacity in Engl<strong>and</strong> <strong>and</strong> Wales<br />

An adult client with capacity (over 18) has the right to refuse any<br />

medical treatment, whatever the c<strong>on</strong>sequences, unless it is compulsory<br />

treatment for a mental disorder (for some<strong>on</strong>e secti<strong>on</strong>ed under the<br />

Mental Health Act). The Mental Capacity Act, 2005, provides a statutory<br />

framework for substitute decisi<strong>on</strong>-making for those who lack capacity.<br />

It states that a pers<strong>on</strong> lacks mental capacity if at the material time he<br />
