have been made known. [27] The Bill does not specify a hierarchy<br />

<strong>of</strong> authority in this regard. It would therefore appear that a<br />

health pr<strong>of</strong>essi<strong>on</strong>al would need to take into account the views <strong>of</strong><br />

all <strong>of</strong> these people when c<strong>on</strong>sidering treatment to be provided.<br />

However, a health pr<strong>of</strong>essi<strong>on</strong>al’s overriding duty is still to act in<br />

the patients’ best interests. [28]<br />

• Any act which is d<strong>on</strong>e or any decisi<strong>on</strong> made under this Bill for or<br />

<strong>on</strong> behalf <strong>of</strong> a pers<strong>on</strong> who lacks capacity must be d<strong>on</strong>e or made<br />

in her/his best interests.<br />

2.5.2 Approach to decisi<strong>on</strong>-making<br />

Protecti<strong>on</strong> from liability for those providing health care <strong>and</strong> treatment<br />

Head 16 <strong>of</strong> the Scheme <strong>of</strong> Mental Capacity Bill [29] provides protecti<strong>on</strong><br />

from liability in certain circumstances for informal decisi<strong>on</strong>-making in<br />

relati<strong>on</strong> to a pers<strong>on</strong> who performs an act in c<strong>on</strong>necti<strong>on</strong> with the pers<strong>on</strong>al<br />

care, healthcare or treatment <strong>of</strong> another pers<strong>on</strong> whose decisi<strong>on</strong>-making<br />

capacity is in doubt. Before a medical practiti<strong>on</strong>er (or another pers<strong>on</strong>)<br />

performs any act in c<strong>on</strong>necti<strong>on</strong> with the pers<strong>on</strong>al care, health care or<br />

treatment <strong>of</strong> another pers<strong>on</strong> whose decisi<strong>on</strong>-making capacity is in doubt,<br />

she/he must have regard to the general principles <strong>and</strong> comply with the<br />

following requirements:<br />

1. Before doing the act, take reas<strong>on</strong>able steps to establish whether<br />

the pers<strong>on</strong> lacks capacity in relati<strong>on</strong> to the matter in questi<strong>on</strong>.<br />
