2.5.1 Guiding principles<br />

The Scheme <strong>of</strong> Mental Capacity Bill c<strong>on</strong>tains a number <strong>of</strong> guiding<br />

principles to assist both the court <strong>and</strong> pers<strong>on</strong>s making a decisi<strong>on</strong> <strong>on</strong><br />

behalf <strong>of</strong> an adult who lacks capacity: [26]<br />

• Presumpti<strong>on</strong> <strong>of</strong> capacity: In Irish law, as in many other<br />

jurisdicti<strong>on</strong>s, there is a presumpti<strong>on</strong> that adults have capacity,<br />

which can be removed <strong>on</strong>ly if there is clear evidence that the<br />

pers<strong>on</strong> lacks the necessary capacity.<br />

• No interventi<strong>on</strong> is to take place unless it is necessary, having<br />

regard to the needs <strong>and</strong> individual circumstances <strong>of</strong> the pers<strong>on</strong>,<br />

including whether the pers<strong>on</strong> is likely to increase or regain<br />

capacity.<br />

• A pers<strong>on</strong> will not be treated as unable to make a decisi<strong>on</strong> unless<br />

all practicable steps to help him/her to do so have been taken<br />

without success.<br />

• A pers<strong>on</strong> is not to be treated as unable to make a decisi<strong>on</strong> merely<br />

because she/he makes an unwise decisi<strong>on</strong>.<br />

• Any act d<strong>on</strong>e or decisi<strong>on</strong> made under the Bill must be d<strong>on</strong>e or<br />

made in the way which is least restrictive <strong>of</strong> the pers<strong>on</strong>’s rights<br />

<strong>and</strong> freedom <strong>of</strong> acti<strong>on</strong>.<br />

• Due regard must be given to the need to respect the right <strong>of</strong> a<br />

pers<strong>on</strong> to her/his dignity, bodily integrity, privacy <strong>and</strong> aut<strong>on</strong>omy.<br />
