(discussed below) <str<strong>on</strong>g>Literature</str<strong>on</strong>g> will <str<strong>on</strong>g>Review</str<strong>on</strong>g> apply to <strong>on</strong> c<strong>on</strong>traceptive Provisi<strong>on</strong> <strong>of</strong> <strong>Appropriate</strong> treatment <strong>and</strong> <strong>and</strong> <strong>Accessible</strong> to<br />

other medical Support treatments/interventi<strong>on</strong>s to People with an Intellectual in relati<strong>on</strong> Disability to the who pregnancy are<br />

Experiencing Crisis Pregnancy<br />

experiences <strong>of</strong> women with intellectual disabilities. Namhi [23] (2003),<br />

in their report <strong>on</strong> legal capacity <strong>and</strong> decisi<strong>on</strong>-making, stated that<br />

c<strong>on</strong>tracepti<strong>on</strong> should be subject to the same rules that apply for medical<br />

treatments in general.<br />

The aim <strong>of</strong> the Scheme <strong>of</strong> Mental Capacity Bill 2008 is to give effect to the<br />

Hague C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the Internati<strong>on</strong>al Protecti<strong>on</strong> <strong>of</strong> Adults [24] <strong>and</strong> the<br />

UN C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the Rights <strong>of</strong> Pers<strong>on</strong>s with Disabilities [25].<br />

2.5 Scheme <strong>of</strong> Mental Capacity Bill, 2008<br />

This secti<strong>on</strong> will examine the provisi<strong>on</strong>s <strong>of</strong> the Scheme <strong>of</strong> Mental<br />

Capacity Bill, 2008 <strong>and</strong> the issues surrounding capacity assessment <strong>and</strong><br />

proxy decisi<strong>on</strong>-making arising from the Bill.<br />

The Scheme <strong>of</strong> Mental Capacity Bill includes secti<strong>on</strong>s <strong>on</strong> the following<br />

areas:<br />

• Guiding principles<br />

• Definiti<strong>on</strong> <strong>and</strong> presumpti<strong>on</strong> <strong>of</strong> capacity<br />

• Best interests<br />

• Power to make decisi<strong>on</strong>s <strong>and</strong> appoint pers<strong>on</strong>al guardians<br />

• Informal decisi<strong>on</strong>-making<br />

24 Irel<strong>and</strong> is a signatory to the Hague C<strong>on</strong>venti<strong>on</strong>, which came into force in January<br />

2009. The C<strong>on</strong>venti<strong>on</strong> is designed to improve the protecti<strong>on</strong> in internati<strong>on</strong>al<br />

situati<strong>on</strong>s <strong>of</strong> adults who, by reas<strong>on</strong> <strong>of</strong> an impairment or insufficiency in their<br />

pers<strong>on</strong>al faculties, are not able to safeguard their own interests.<br />

25 The UN C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the Rights <strong>of</strong> Pers<strong>on</strong>s with Disabilities was adopted by the<br />

UN General Assembly in 2006. It is a major Human Rights C<strong>on</strong>venti<strong>on</strong> which aims<br />

to promote, protect <strong>and</strong> ensure the full <strong>and</strong> equal enjoyment <strong>of</strong> all human rights<br />

by pers<strong>on</strong>s with disabilities.
