in caring for a pers<strong>on</strong> or interested in his/her welfare before<br />

carrying out acts in relati<strong>on</strong> to a pers<strong>on</strong> who lacks capacity<br />

(Mental Capacity Act, 2005, Engl<strong>and</strong> <strong>and</strong> Wales).<br />

• The introducti<strong>on</strong> <strong>of</strong> a st<strong>and</strong>ard assessment protocol (c<strong>on</strong>tained<br />

in a code <strong>of</strong> practice/guidelines), which would reduce bias<br />

<strong>and</strong> introduce c<strong>on</strong>sistency in the way that mental capacity<br />

assessments are c<strong>on</strong>ducted.<br />

• The need to recognise the heterogeneity <strong>of</strong> people with<br />

intellectual disabilities in any assessment <strong>of</strong> capacity.<br />

• A requirement in legislati<strong>on</strong> that where a pers<strong>on</strong> lacks capacity<br />

people follow certain steps to help them work out whether a<br />

particular act or decisi<strong>on</strong> is in a pers<strong>on</strong>’s best interests.
