A number <strong>of</strong> issues have been identified (D<strong>on</strong>nelly, 2008) that<br />

require detailed guidance in the form <strong>of</strong> a Code <strong>of</strong> Practice, which should<br />

accompany legislati<strong>on</strong> in this area. These include:<br />

• The proposed definiti<strong>on</strong> <strong>of</strong> capacity is too open-ended; decisi<strong>on</strong>makers<br />

have very little guidance in developing <strong>and</strong> applying the<br />

test for capacity in individual cases.<br />

Support to People with an Intellectual Disability who are<br />

<strong>Accessible</strong><br />

<strong>and</strong> <strong>Appropriate</strong> <strong>of</strong> Provisi<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>Review</str<strong>on</strong>g> <str<strong>on</strong>g>Literature</str<strong>on</strong>g><br />

Experiencing Crisis Pregnancy<br />

• Interpretati<strong>on</strong> <strong>of</strong> the principles within the Scheme <strong>of</strong> Mental<br />

Capacity Bill 2008, <strong>and</strong> their applicati<strong>on</strong> in practice; for example,<br />

Principle (c) states that ‘a pers<strong>on</strong> shall not be treated as unable<br />

to make a decisi<strong>on</strong> unless all practicable steps to help him or<br />

her to do so have been taken without success’. [91] While the<br />

intenti<strong>on</strong> here is to provide supported decisi<strong>on</strong>-making, the<br />

kind <strong>and</strong> level <strong>of</strong> support people will need to help them make a<br />

decisi<strong>on</strong> needs further guidance.<br />

• Further guidance is needed <strong>on</strong> what should be c<strong>on</strong>sidered when<br />

trying to work out the best interests <strong>of</strong> a pers<strong>on</strong> who lacks<br />

capacity to make a particular decisi<strong>on</strong>.<br />

6.4 Internati<strong>on</strong>al good practice in capacity assessment<br />

Elements <strong>of</strong> good practice in assessing capacity to c<strong>on</strong>sent to treatment<br />

were identified from other jurisdicti<strong>on</strong>s:<br />

• A functi<strong>on</strong>al approach to assessment <strong>of</strong> capacity (used in most<br />

jurisdicti<strong>on</strong>s), where capacity is decisi<strong>on</strong>-specific <strong>and</strong> timespecific<br />

rather than global or permanent. Before any declarati<strong>on</strong><br />

<strong>of</strong> incapacity, c<strong>on</strong>siderati<strong>on</strong> needs to be given as to whether it<br />

would be possible either to improve the pers<strong>on</strong>’s relevant<br />

functi<strong>on</strong>al abilities <strong>and</strong>/or to simplify or otherwise amend the<br />

situati<strong>on</strong> to improve the pers<strong>on</strong>’s capacity.<br />

• Entitlement <strong>of</strong> people to receive informati<strong>on</strong> that is appropriate,<br />

relevant <strong>and</strong> through such channels as enable them to make a<br />

decisi<strong>on</strong> about their healthcare. The right to comprehensible<br />
