experience <strong>of</strong> sexual relati<strong>on</strong>s <strong>and</strong> pregnancy. Legislati<strong>on</strong> relevant<br />

to specific decisi<strong>on</strong>s <strong>and</strong> tests <strong>of</strong> capacity was explored, i.e. capacity<br />

to c<strong>on</strong>sent to medical treatment <strong>and</strong>, in particular, to c<strong>on</strong>traceptive<br />

treatment <strong>and</strong> capacity to c<strong>on</strong>sent to sexual relati<strong>on</strong>s.<br />

Experiencing Crisis Pregnancy<br />

There is a history <strong>of</strong> civil law cases relating to capacity to c<strong>on</strong>sent to<br />

medical treatment <strong>and</strong> much research <strong>on</strong> decisi<strong>on</strong> making capacity<br />

has c<strong>on</strong>cerned c<strong>on</strong>sent to treatment. Meanwhile, it has been observed<br />

that there has been far less c<strong>on</strong>siderati<strong>on</strong> <strong>of</strong> capacity in the c<strong>on</strong>text <strong>of</strong><br />

c<strong>on</strong>senting to sexual relati<strong>on</strong>ships (Murphy, 2003). For example, there is<br />

no specific test designed to cover capacity to c<strong>on</strong>sent to sexual relati<strong>on</strong>s<br />

in the c<strong>on</strong>text <strong>of</strong> the civil law c<strong>on</strong>cerning a pers<strong>on</strong>’s private rights to enter<br />

into voluntary relati<strong>on</strong>ships (BMA <strong>and</strong> the Law Society, 2004). Capacity<br />

to c<strong>on</strong>sent to sexual relati<strong>on</strong>s arises in the c<strong>on</strong>text <strong>of</strong> the provisi<strong>on</strong>s<br />

available in criminal law to protect vulnerable people from potentially<br />

abusive relati<strong>on</strong>ships.<br />

6.2 Assessment <strong>of</strong> capacity to c<strong>on</strong>sent to c<strong>on</strong>traceptive treatment<br />

In Irel<strong>and</strong>, the Scheme <strong>of</strong> Mental Capacity Bill 2008 sets out the various<br />

provisi<strong>on</strong>s relating to assessing capacity <strong>of</strong> vulnerable people to make<br />

specific decisi<strong>on</strong>s, excluding capacity to c<strong>on</strong>sent to have sexual relati<strong>on</strong>s.<br />

The legislati<strong>on</strong> is relevant to this topic in relati<strong>on</strong> to the assessment<br />

<strong>of</strong> capacity to make medical treatment decisi<strong>on</strong>s, i.e. decisi<strong>on</strong>s about<br />

c<strong>on</strong>tracepti<strong>on</strong>, including sterilisati<strong>on</strong>.<br />

6.3 Gaps in relati<strong>on</strong> to assessment <strong>of</strong> capacity to make<br />

healthcare decisi<strong>on</strong>s<br />

Gaps in the current draft legislati<strong>on</strong> <strong>and</strong> procedures in relati<strong>on</strong> to<br />

assessment <strong>of</strong> capacity to make healthcare decisi<strong>on</strong>s include the<br />

following:<br />

• Where an adult does not have the capacity to c<strong>on</strong>sent to or refuse<br />

medical treatment, it is comm<strong>on</strong> medical practice in Irel<strong>and</strong><br />

to have their next <strong>of</strong> kin sign a c<strong>on</strong>sent form in relati<strong>on</strong> to the<br />

treatment (LRC, 2005). This practice has no legal st<strong>and</strong>ing. This<br />

vacuum in the law could produce a situati<strong>on</strong> where the right <strong>of</strong> a<br />

woman with intellectual disability to make decisi<strong>on</strong>s about her
