Laws that prohibit specific sexual relati<strong>on</strong>ships<br />

• It has been argued that the specific power held by people in<br />

positi<strong>on</strong>s in authority undermines the potential for free c<strong>on</strong>sent<br />

(McCarthy <strong>and</strong> Thomps<strong>on</strong>, 2004). In recogniti<strong>on</strong> <strong>of</strong> this, laws<br />

have been created that avoid tests <strong>of</strong> capacity <strong>and</strong> c<strong>on</strong>sent <strong>and</strong><br />

which may lead to higher prosecuti<strong>on</strong> rates (McCarthy <strong>and</strong><br />

Thomps<strong>on</strong>, 2004). In Engl<strong>and</strong> <strong>and</strong> Wales, secti<strong>on</strong>s 38-41 <strong>of</strong> the<br />

Sexual Offences Act 2003 deal with <strong>of</strong>fences where the defendant<br />

is in some form <strong>of</strong> care relati<strong>on</strong>ship with the complainant. In<br />

these <strong>of</strong>fences any sexual activity between the care worker<br />

<strong>and</strong> the pers<strong>on</strong> with the mental disorder is prohibited whilst<br />

that relati<strong>on</strong>ship c<strong>on</strong>tinues. Secti<strong>on</strong> 17 <strong>of</strong> the Crimes (Sexual<br />

Offences) Act 2006 in Victoria, Australia, provides another<br />

example <strong>of</strong> where it is an <strong>of</strong>fence for a care worker to engage in<br />

an act <strong>of</strong> sexual penetrati<strong>on</strong> or to commit an indecent act with a<br />

pers<strong>on</strong> with a cognitive impairment.<br />

• One study in the United Kingdom dem<strong>on</strong>strated that about<br />

half <strong>of</strong> the participants with intellectual disabilities involved<br />

in the research would have been unable to c<strong>on</strong>sent to sexual<br />

relati<strong>on</strong>ships because they did not underst<strong>and</strong> about pregnancy<br />

<strong>and</strong>/or sexually transmitted diseases (Murphy <strong>and</strong> O’Callaghan,<br />

2004). The authors c<strong>on</strong>cluded that it was essential for people<br />

to have <strong>on</strong>-going access to sex educati<strong>on</strong> (as opposed to the<br />

‘<strong>on</strong>e shot’ variety), particularly with regard to sexual health <strong>and</strong><br />

pregnancy, c<strong>on</strong>tracepti<strong>on</strong>, safe sex, abuse, <strong>and</strong> some aspects <strong>of</strong><br />

the law (such as c<strong>on</strong>sent).
