• Laws that prohibit sex with people deemed unable to c<strong>on</strong>sent<br />

to sex are based <strong>on</strong> the need to protect some people who<br />

are so disabled as to be unable to give c<strong>on</strong>sent to any sexual<br />

relati<strong>on</strong>ship. In Irel<strong>and</strong> Secti<strong>on</strong> 5 <strong>of</strong> the Criminal Law (Sexual<br />

Offences) Act 1993 falls under this category. Secti<strong>on</strong> 5<br />

criminalises sexual activity with women who have a ‘mental<br />

impairment’, which is defined as rendering a pers<strong>on</strong> ‘incapable<br />

<strong>of</strong> living an independent life or <strong>of</strong> guarding against serious<br />

exploitati<strong>on</strong>’ unless the two parties are married to each other.<br />

Thus, it may be an <strong>of</strong>fence to engage in sexual activity with a<br />

pers<strong>on</strong> with an intellectual disability even if the pers<strong>on</strong> c<strong>on</strong>sents.<br />

• It has been argued that if sexual development <strong>and</strong> reproducti<strong>on</strong><br />

are to be possible, it must be legally acceptable for people with<br />

a ‘mental h<strong>and</strong>icap’ to enter into sexual relati<strong>on</strong>ships. [79] Fear<br />

<strong>of</strong> facilitating the commissi<strong>on</strong> <strong>of</strong> a criminal <strong>of</strong>fence <strong>on</strong> the part<br />

<strong>of</strong> parents <strong>and</strong> carers may prevent relati<strong>on</strong>ships between two<br />

adults with intellectual disability developing even where they have<br />

capacity to c<strong>on</strong>sent <strong>and</strong> there is no element <strong>of</strong> exploitati<strong>on</strong> (LRC,<br />

2005).<br />

• Other jurisdicti<strong>on</strong>s using diagnostic criteria in relati<strong>on</strong> to capacity<br />

to c<strong>on</strong>sent to sexual relati<strong>on</strong>ships include Western Australia <strong>and</strong><br />

forty-five states in the U.S.<br />

Laws that incorporate a functi<strong>on</strong>al approach to assessment <strong>of</strong><br />

capacity to c<strong>on</strong>sent to sexual relati<strong>on</strong>s<br />

• The Sexual Offences Act 2003 in Engl<strong>and</strong> <strong>and</strong> Wales provides an<br />

example <strong>of</strong> the functi<strong>on</strong>al approach, where capacity to c<strong>on</strong>sent<br />

is articulated in terms <strong>of</strong> a pers<strong>on</strong>’s underst<strong>and</strong>ing <strong>of</strong> the nature<br />

<strong>and</strong> c<strong>on</strong>sequences <strong>of</strong> the act <strong>and</strong> her/his ability to communicate<br />

choice.<br />
