sexual rights <str<strong>on</strong>g>Literature</str<strong>on</strong>g> for people <str<strong>on</strong>g>Review</str<strong>on</strong>g> with <strong>on</strong> learning Provisi<strong>on</strong> disabilities <strong>of</strong> <strong>Appropriate</strong> <strong>and</strong> protecti<strong>on</strong> <strong>and</strong> <strong>Accessible</strong> from<br />

3.12.2 Other jurisdicti<strong>on</strong>s<br />

In most states in Australia, the knowledge required for legal c<strong>on</strong>sent to<br />

a sexual act is <strong>on</strong>ly that the pers<strong>on</strong> underst<strong>and</strong>s the nature <strong>of</strong> the act<br />

(Grayd<strong>on</strong>, 2006) but there is no need to know the c<strong>on</strong>sequences. [73]<br />

This decisi<strong>on</strong> <strong>of</strong> the Supreme Court <strong>of</strong> Victoria, in the case <strong>of</strong> Morgan<br />

(1970, VR 337) represents a less stringent test (where c<strong>on</strong>siderati<strong>on</strong><br />

<strong>of</strong> the c<strong>on</strong>sequences <strong>of</strong> sexual acts appears to have been excluded).<br />

It must be proved that the pers<strong>on</strong> does not have sufficient knowledge<br />

or underst<strong>and</strong>ing to comprehend either that sex may involve physical<br />

penetrati<strong>on</strong> <strong>of</strong> the body or that penetrati<strong>on</strong> is an act <strong>of</strong> sexual c<strong>on</strong>necti<strong>on</strong>,<br />

as distinct from an act <strong>of</strong> a totally different character. According to the<br />

Victorian Law Reform Commissi<strong>on</strong> (2001) using this st<strong>and</strong>ard most<br />

people with impaired mental functi<strong>on</strong>ing will be capable <strong>of</strong> c<strong>on</strong>senting to<br />

sexual activity. The Morgan st<strong>and</strong>ard is lower than that <strong>of</strong> most American<br />

states, which require underst<strong>and</strong>ing <strong>of</strong> the nature <strong>and</strong> c<strong>on</strong>sequences <strong>of</strong><br />

the act (Sundram <strong>and</strong> Stavis, 1994).<br />

The Morgan directi<strong>on</strong> was elaborated up<strong>on</strong> in R v Mueller (2005), another<br />

case in which it was alleged that the complainant lacked capacity to<br />

c<strong>on</strong>sent. The jury was directed that it was sufficient if the ‘complainant<br />

has knowledge or underst<strong>and</strong>ing <strong>of</strong> what the act comprises, <strong>and</strong> <strong>of</strong> its<br />

character ... then she has all that the law requires for capacity to c<strong>on</strong>sent<br />

(Grayd<strong>on</strong>, 2006).<br />

An advantage <strong>of</strong> retaining the Morgan st<strong>and</strong>ard is that the sexual<br />

aut<strong>on</strong>omy <strong>of</strong> pers<strong>on</strong>s with intellectual disability would be preserved.<br />

Research has dem<strong>on</strong>strated that <strong>on</strong>ly about half the populati<strong>on</strong> with<br />

intellectual disability (in studies carried out in the UK <strong>and</strong> Australia)<br />

reported having ever received sex educati<strong>on</strong> (O’Callaghan & Murphy,<br />
