• Offences where the defendant is in some form <strong>of</strong> care<br />

relati<strong>on</strong>ship with the complainant; these <strong>of</strong>fences may be<br />

committed regardless <strong>of</strong> c<strong>on</strong>sent (Secti<strong>on</strong>s 38 – 41 (discussed<br />

below)).<br />

A pers<strong>on</strong> is unable to refuse if she ‘lacks the capacity to choose whether<br />

to agree to the touching (whether because she/he lacks sufficient<br />

underst<strong>and</strong>ing <strong>of</strong> the nature or reas<strong>on</strong>ably foreseeable c<strong>on</strong>sequences<br />

<strong>of</strong> what is being d<strong>on</strong>e or any other reas<strong>on</strong>)’ or is unable to communicate<br />

such a choice. [71] Capacity to c<strong>on</strong>sent is articulated in terms <strong>of</strong><br />

functi<strong>on</strong>al capacity (<strong>and</strong> not by a diagnostic or status approach) to<br />

underst<strong>and</strong> the nature <strong>and</strong> c<strong>on</strong>sequences <strong>of</strong> the act <strong>and</strong> a pers<strong>on</strong> with a<br />

mental disorder’s ability to communicate his/her choice.<br />

Sufficient underst<strong>and</strong>ing <strong>of</strong> the nature <strong>and</strong> reas<strong>on</strong>ably foreseeable<br />

c<strong>on</strong>sequences might include knowing that sexual activity is different from<br />

pers<strong>on</strong>al care <strong>and</strong> that some sexual activities can lead to pregnancy or<br />

the transmissi<strong>on</strong> <strong>of</strong> disease. Other reas<strong>on</strong>s why a pers<strong>on</strong> may be unable<br />

to refuse might include not underst<strong>and</strong>ing that they had a choice through<br />

instituti<strong>on</strong>alisati<strong>on</strong>, or because they suffered from a c<strong>on</strong>diti<strong>on</strong> that might<br />

affect the ability to make a choice. [72]<br />

It is a requirement <strong>of</strong> the <strong>of</strong>fences under Secti<strong>on</strong>s 30 – 33 that the<br />

<strong>of</strong>fender knew or could reas<strong>on</strong>ably have been expected to know that<br />

because <strong>of</strong> a mental disorder the pers<strong>on</strong> was likely to be unable to<br />

refuse.<br />

The Sexual Offences Act 2003 introduces a new <strong>of</strong>fence <strong>of</strong> ‘obtaining<br />

sexual activity by inducement, threat or decepti<strong>on</strong> with a pers<strong>on</strong> who<br />

has a learning disability or mental disorder’. This <strong>of</strong>fence is aimed at<br />

individuals who both deliberately <strong>and</strong> repeatedly target people with<br />

learning disabilities because <strong>of</strong> their vulnerability to sexual exploitati<strong>on</strong><br />

(McCarthy <strong>and</strong> Thomps<strong>on</strong>, 2004). In these <strong>of</strong>fences there is no need<br />

to prove that the ‘victim’ is unable to refuse. This <strong>of</strong>fence is intended<br />

to protect individuals with learning disabilities who with other people<br />
