In its report <strong>on</strong> sexual <strong>of</strong>fences, the Law Reform Commissi<strong>on</strong> (LRC,<br />

However, this proposal was not included in the subsequent legislati<strong>on</strong>,<br />

the 1993 Act. Therefore, it is an <strong>of</strong>fence to engage in sexual activity with a<br />

pers<strong>on</strong> with an intellectual disability (that comes within the definiti<strong>on</strong> <strong>of</strong><br />

mental impairment), even if the pers<strong>on</strong> c<strong>on</strong>sents.<br />

The Law Reform Commissi<strong>on</strong> (LRC 2005) noted that a regrettable effect<br />

<strong>of</strong> Secti<strong>on</strong> 5 <strong>of</strong> the 1993 Act is that outside a marriage c<strong>on</strong>text a sexual<br />

relati<strong>on</strong>ship between two ‘mentally impaired’ pers<strong>on</strong>s may c<strong>on</strong>stitute a<br />

criminal <strong>of</strong>fence because there is no provisi<strong>on</strong> for c<strong>on</strong>sent as a defence in<br />

respect <strong>of</strong> a relati<strong>on</strong>ship between adults who were both capable <strong>of</strong> giving<br />

a real c<strong>on</strong>sent to sexual intercourse (McAuley <strong>and</strong> McCutche<strong>on</strong>, 2000:<br />

515). The law, therefore, effectively blocks a mutually c<strong>on</strong>sensual sexual<br />

relati<strong>on</strong>ship between pers<strong>on</strong>s c<strong>on</strong>sidered to have a limited decisi<strong>on</strong>making<br />

ability. Similarly, Grayd<strong>on</strong> et al. (2006) have been critical <strong>of</strong> the<br />

protective nature <strong>of</strong> Secti<strong>on</strong> 5 <strong>of</strong> the 1993 Act for the fact that outside<br />

<strong>of</strong> a marriage c<strong>on</strong>text it is an <strong>of</strong>fence for any pers<strong>on</strong> to have sexual<br />

relati<strong>on</strong>s with a pers<strong>on</strong> incapable <strong>of</strong> protecting themselves against sexual<br />

exploitati<strong>on</strong>.<br />

It has been argued that if sexual development <strong>and</strong> reproducti<strong>on</strong> are<br />

to be possible, it must be legally acceptable for people with a ‘mental<br />

h<strong>and</strong>icap’ to enter into sexual relati<strong>on</strong>ships. [65] In this regard, the<br />

Law Reform Commissi<strong>on</strong> notes that fear <strong>of</strong> facilitating the commissi<strong>on</strong><br />

<strong>of</strong> a criminal <strong>of</strong>fence <strong>on</strong> the part <strong>of</strong> parents <strong>and</strong> carers may prevent<br />

relati<strong>on</strong>ships between two adults with intellectual disability developing<br />

even where they have capacity to c<strong>on</strong>sent <strong>and</strong> there is no element <strong>of</strong><br />

exploitati<strong>on</strong> (LRC, 2005: 142).<br />

O’Malley (1996: 133) has commented that the criminal law has a<br />

limited capacity to achieve a balance between protecti<strong>on</strong> <strong>and</strong> sexual<br />
