DEFINITIONS
lnactive Bylaws are descríbed as being bylaws in which no further
action has been taken in regards to further readings of Council or have
not proceeded due to conditions set by Council not being completed
over a 12 month period from the last official reading of the Bylaw.
PROCEDURES
Staff will review any outstanding Bylaws which have been inactive for
12 months.
ln rezoning and OCP Bylaw amendments, planning staff will confirm
that bylaw is inactíve and that the applicant is not actively working in
completing the conditions of Council. The applicant will be provided, in
writing, a request from City staff as to the status of their amendment
Bylaw and advised that Council will be proceeding with consideration of
rescinding the initial readings of the Bylaw due to inactivity. The
applicant will be given an opportunity to respond to Council in this
regard, and if no response is received within the time frame allotted (30
days), Council will proceed with consideration.
For internal Bylaws which may have been deferred pending further
information, or not acted upon due to other circumstances, Council may
request an update on the Bylaw from the originator and then consider
rescinding the initial readings of the Bylaw."
4. RDNO parks officials have indicated they require "cash in lieu" of parkland
dedication when the property is subdivided into single family bareland strata lots,
Open space development cost charges will also be collected at the subdivision
stage. As shown on Figure 5, there will be two private open space/park areas
within the bareland strata subdivision. Nearby Marshall Fields will provide public
parkland for the residents of the proposed development.
F. Relevant Historv:
1. Council granted First and Second Readings of the subject rezoning bylaw on
November 26,2007. The Official Public Hearing was held on January 14, 2008 and
Third Reading was granted on January 28,2008. Council policy allows for a one
year bylaw processing period from the granting of Third Reading.
2. Council granted a six month extension to the bylaw processing period which
expired on January 28, 2009. The efension period ended July 28, 2009. Council
granted a fufther six month extension which recently expired on January 28,2010.
