E. could have launched an appeal against the Commissione’s decision. However, by this stage<br />

time had passed in <strong>CIE</strong> and E. was so upset and distressed that he said that he wanted to do<br />

anything possible to leave <strong>CIE</strong> detention and he just saw the appeal as prolonging the<br />

situation. We must remember that E. is an eighteen-year-old who is detained in a foreign<br />

country whilst mourning the loss <strong>of</strong> his loved ones who recently died in conflict. Since the<br />

decision to appeal was ultimately in E.’s hands, there was nothing else that E.’s lawyer could<br />

do at this stage. At the present moment E. is simply waiting for his repatriation to take place.<br />

Perhaps if E. had received understandable legal advice on asylum when he arrived in Italy or<br />

if E. had had a better experience as a child in the children’s refuge then things might have<br />

been worked out differently. Perhaps if E. had been able to speak to a lawyer with an<br />

interpreter in Switzerland or if he had been able to speak to a lawyer for comprehensive and<br />

interpreted advice and informed representation in <strong>Turin</strong> before his validation hearing, then<br />

things might have been different.<br />
