18.5.1 Any case pending prior to the Effective Date, or brought after the Effective<br />

Date but based on acts or omissions that occurred before the Effective Date,<br />

shall be governed by the anti-doping rules in force at the time of the antidoping<br />

rule violation occurred, subject to any application of the principle of lex<br />

mitior by the hearing panel determining the case.<br />

18.5.2 Subject always to Article 10.7.5, anti-doping rule violations committed under<br />

rules in force prior to the Effective Date shall be taken into account as prior<br />

violations for purposes of determining sanctions under Article 10.7. A prior<br />

offence involving a substance defined under the <strong>Rules</strong>, for which a period of<br />

Ineligibility of less than two years was imposed, shall be considered a<br />

Reduced Sanction violation for purposes of Article 10.7.1.<br />

18.6 Subject to Article 18.2, the <strong>Rules</strong> are governed by <strong>and</strong> shall be construed in<br />

accordance with English law. Strictly without prejudice to the arbitration provisions of<br />

Articles 8 <strong>and</strong> 13 of the <strong>Rules</strong>, disputes relating to the <strong>Rules</strong> shall be subject to the<br />

exclusive jurisdiction of the courts of <strong>Engl<strong>and</strong></strong> <strong>and</strong> <strong>Wales</strong>.<br />
