18.5.1 Any case pending prior to the Effective Date, or brought after the Effective
Date but based on acts or omissions that occurred before the Effective Date,
shall be governed by the anti-doping rules in force at the time of the antidoping
rule violation occurred, subject to any application of the principle of lex
mitior by the hearing panel determining the case.
18.5.2 Subject always to Article 10.7.5, anti-doping rule violations committed under
rules in force prior to the Effective Date shall be taken into account as prior
violations for purposes of determining sanctions under Article 10.7. A prior
offence involving a substance defined under the Rules, for which a period of
Ineligibility of less than two years was imposed, shall be considered a
Reduced Sanction violation for purposes of Article 10.7.1.
18.6 Subject to Article 18.2, the Rules are governed by and shall be construed in
accordance with English law. Strictly without prejudice to the arbitration provisions of
Articles 8 and 13 of the Rules, disputes relating to the Rules shall be subject to the
exclusive jurisdiction of the courts of England and Wales.
