the National <strong>Cricket</strong> Federation; <strong>and</strong><br />

12.2.3 any further offences shall result in a £1000 fine for the First Class<br />

County by the National <strong>Cricket</strong> Federation.<br />

12.3 Any First Class County whose squad is unavailable for sample collection due to the<br />

provision of inaccurate squad whereabouts information will be sanctioned as follows:<br />

12.3.1 for a first offence, the First Class County shall be given a formal<br />

written warning from National <strong>Cricket</strong> Federation <strong>and</strong> shall be liable<br />

for any costs incurred by the National <strong>Cricket</strong> Federation as a result<br />

of the squad being unavailable; <strong>and</strong><br />

12.3.2 for any subsequent offence during the same season, the First Class<br />

County shall be fined £1000 <strong>and</strong> the First Class County shall be<br />

liable for any costs incurred by National <strong>Cricket</strong> Federation as a<br />

result of the squad being unavailable.<br />

12.4 The obligations on First Class Counties under this Article 12 in no way diminish,<br />

remove or otherwise affect the obligations on <strong>Cricket</strong>ers in any International<br />

Registered Testing Pool (or any other testing pool as may be appropriate), under<br />

these <strong>Rules</strong>, the ICC Code, the World <strong>Anti</strong>-<strong>Doping</strong> Code or otherwise, to provide<br />

whereabouts information.<br />

12.5 <strong>Cricket</strong>ers shall not be guilty of a Missed Test or Filing Failure as a result of incorrect<br />

information provided by, or any failure to provide information on the part of, the First<br />

Class County under this Article 12.<br />

ARTICLE 13 APPEALS<br />

13.1 Decisions Subject to Appeal<br />

Decisions made under the <strong>Rules</strong> may be challenged solely by appeal as set out in this<br />

Article 13 (or as otherwise provided in the <strong>Rules</strong>). Such decisions shall remain in effect<br />

while under appeal unless the appellate body orders otherwise.<br />

13.2 Appeals from Decisions Regarding <strong>Anti</strong>-<strong>Doping</strong> Rule Violations,<br />

Consequences, <strong>and</strong> Provisional Suspensions<br />

13.2.1 The following decisions -- a decision that an anti-doping rule violation was (or<br />

was not) committed, a decision imposing Consequences (or not imposing<br />

Consequences) for an anti-doping rule violation; a decision that a charge<br />

cannot go forward for procedural reasons (including, for example, because<br />

too much time has passed); a decision that the National <strong>Cricket</strong> Federation or<br />

a hearing panel lacks jurisdiction to deal with an alleged anti-doping rule<br />

violation; a decision not to pursue an Adverse Analytical Finding or an<br />

Atypical Finding as an anti-doping rule violation under Article 7.2 or 7.3; a<br />

decision not to bring a charge after an investigation under Article 7.5; a<br />

decision to suspend a period of Ineligibility in accordance with Article 10.5.3;<br />

a decision to reinstate a suspended period of Ineligibility in accordance with<br />

Article 10.5.3; a decision under Article 10.10.2 in relation to participation<br />

whilst Ineligible; <strong>and</strong> a decision to reduce a period of Ineligibility imposed<br />

under a predecessor version of the <strong>Rules</strong> in accordance with Article 18.5.3 --<br />

may be appealed by any of the following parties exclusively as provided in<br />

this Article 13:<br />

13.2.1.1 the <strong>Cricket</strong>er or <strong>Cricket</strong>er Support Personnel who is the subject of<br />

the decision being appealed;<br />
